This decision applies to agencies and units delegated to perform state management tasks on food safety in the industry and trade sector within Bac Ninh province. It includes food production and business establishments under the management responsibility of the industry and trade sector in the province, including: establishments producing and trading alcoholic beverages, beer, soft drinks, processed dairy products, vegetable oil, processed products from flour and starch, cakes, jams, candies, food packaging materials and containers under the management responsibility of the industry and trade sector, food safety management for supermarkets, shopping malls, convenience stores, establishments in the storage and distribution system, and other types of businesses (hereinafter referred to as production and business establishments). It also applies to relevant organizations and individuals in Bac Ninh province.

According to the Decision, the Provincial People's Committee delegates to the Department of Industry and Trade the State management of food safety in the industrial and trade sector for production and business establishments that have been granted Business Registration Certificates and Investment Registration Certificates by competent provincial authorities. It receives and manages self-declaration dossiers for food products produced and traded within the province for establishments that have been granted Business Registration Certificates and Investment Registration Certificates by competent provincial authorities. It also receives and manages commitment statements for food safety establishments as stipulated in points d, e, and f of Clause 1, Article 12 of Decree No. 15/2018/ND-CP detailing the implementation of some articles of the Law on Food Safety and is subject to the management delegated in Clause 1 of this Article.
The People's Committee at the commune level is delegated the authority to manage state affairs regarding food safety in the industrial and trade sector for production and business establishments that have been granted business registration certificates by the commune (or the former district) or do not have business registration certificates. They are also responsible for receiving and managing self-declaration dossiers for food products produced and traded within the province for food production and business establishments that have been granted business registration certificates by the commune (or the former district) or do not have business registration certificates. Furthermore, they are responsible for receiving and managing food safety commitment statements from production and business establishments as stipulated in points d, e, and f of Clause 1, Article 12 of Decree No. 15/2018/ND-CP and are subject to the delegated management provisions in Clause 1 of this Article.
The Department of Industry and Trade and the People's Committees at the commune level are responsible for directing and urging relevant agencies, units, organizations, individuals, and production and business establishments under their management to implement this Decision.
This decision takes effect from December 15, 2025 and repeals Decision No. 37/2017/QD-UBND of the People's Committee of Bac Giang province promulgating the Regulation on decentralization of state management of food safety under the responsibility of the Industry and Trade sector in Bac Giang province; and Decision No. 45/2020/QD-UBND of the People's Committee of Bac Giang province amending and supplementing Decision No. 37/2017/QD-UBND promulgating the Regulation on decentralization of state management of food safety under the responsibility of the Industry and Trade sector in Bac Giang province.
