The Prime Minister requested strict implementation of regulations on electronic invoices in petroleum business and retail.

Prime Minister Pham Minh Chinh has just signed and issued Official Dispatch No. 26/CD-TTg dated March 26, 2024, on strengthening measures to manage petroleum products and strictly implementing regulations on electronic invoices for petroleum business and retail activities.

Official dispatch sent to the Ministers of the Ministries of Industry and Trade, Finance, Public Security, and Information and Communications; the Inspector General of the Government ; the Chairman of the State Capital Management Committee at Enterprises; the Chairmen of the People's Committees of provinces and centrally-administered cities; the Chairmen and General Directors of: Vietnam Oil and Gas Group, Vietnam Petroleum Group, Binh Son Refinery and Petrochemical Joint Stock Company, Nghi Son Refinery and Petrochemical Company Limited; and the Chairman of the Vietnam Petroleum Association.

The official dispatch states: In accordance with the provisions of the 2019 Law on Tax Administration and Government Decree No. 123/2020/ND-CP dated October 19, 2020, on the use of electronic invoices, the Government and the Prime Minister have issued numerous directives to ministries, agencies, and businesses to implement decisive and comprehensive solutions in managing petroleum products to ensure sufficient supply for production, business, and consumption, and to manage the use of electronic invoices for petroleum business and retail activities, especially recent official dispatches and resolutions: Prime Minister's official dispatches: No. 1123/CD-TTg dated November 18, 2023; No. 1284/CD-TTg dated December 1, 2023; No. 1437/CD-TTg dated December 30, 2023; and No. 09/CD-TTg dated December 24. January 2024 and Resolution No. 28/NQ-CP dated March 5, 2024 of the Government.

However, in the context of the continuing complex and unpredictable global situation affecting world and domestic gasoline prices and supply; many businesses and retail gasoline stations have not strictly complied with regulations; and smuggling and commercial fraud in the gasoline sector still pose a potential risk of becoming more complex...

To further improve the efficiency of petroleum management and operation, ensure sufficient petroleum supply for the domestic market, and strictly implement regulations on the management and use of electronic invoices for petroleum business and retail activities, the Prime Minister requests the Minister of Industry and Trade, the Minister of Finance, the Chairman of the State Capital Management Committee at Enterprises, the Chairmen of the People's Committees of provinces and centrally-administered cities, the Chairmen and General Directors of: Vietnam Oil and Gas Group, Vietnam Petroleum Group, Binh Son Refinery and Petrochemical Joint Stock Company, Nghi Son Refinery and Petrochemical Company Limited, the Chairman of the Vietnam Petroleum Association, and the heads of relevant ministries and agencies to seriously, fully, decisively, promptly, and effectively implement the assigned tasks and solutions in the Government's Resolutions, Telegrams, and directives of the Prime Minister mentioned above; focusing on immediately implementing the following key tasks and solutions:

1. Minister of Industry and Trade

a) Regularly monitor and keep a close watch on the global and domestic petroleum market situation to proactively take measures early and in advance, within the scope of authority and regulations, to meet the sufficient demand for petroleum products for production, business activities, and people's consumption, absolutely preventing shortages or disruptions in the petroleum supply under all circumstances.

b) Directing petroleum businesses and retail petroleum businesses nationwide to fully and correctly comply with all legal regulations on petroleum business; strictly implementing regulations on electronic invoices for petroleum business and retail activities, especially in issuing electronic invoices at retail gasoline stations to customers for each sale and providing electronic invoice data as required. Simultaneously, continue researching solutions to further simplify payment methods through the strong and thorough application of digital transformation in the creation of electronic invoices connected to the tax authorities.

c) Coordinate with the Ministry of Finance and the People's Committees of provinces and centrally-administered cities according to their assigned functions and tasks to direct relevant agencies to consider and handle petroleum businesses that do not comply with regulations on electronic invoices, including requiring them to temporarily suspend business operations and revoke licenses and certificates of eligibility for petroleum business as directed by the Government in Resolution No. 28/NQ-CP dated March 5, 2024; and simultaneously implement comprehensive solutions to ensure the supply of petroleum to the domestic market.

d) Urgently preside over and coordinate with relevant ministries and agencies to thoroughly and comprehensively review and evaluate, and propose the drafting of a Decree to replace the Decrees on petroleum business in accordance with the direction of the Standing Committee of the Government in Notice No. 172/TB-VPCP dated October 14, 2023 and the provisions of the Law on the promulgation of legal normative documents, meeting practical requirements and state management work, harmonizing the interests of the state, people and businesses; submit to the Government in the second quarter of 2024.

2. Minister of Finance

a) The Ministry of Industry and Trade shall preside over and coordinate with the Ministry of Public Security, the People's Committees of provinces and centrally-administered cities, and other relevant ministries, agencies, and localities to immediately implement decisive, synchronized, and effective solutions requiring petroleum businesses to strictly comply with regulations on electronic invoices, issue electronic invoices for each sale at retail gasoline stations, and connect data with tax authorities as prescribed. Strongly promote and thoroughly implement digital transformation in the issuance of electronic invoices connected to tax authorities.

b) Direct the tax authorities to coordinate with the police and other relevant agencies to strengthen inspection and verification of the implementation of regulations on electronic invoices and the issuance of electronic invoices at gasoline and oil retail outlets in accordance with the law, the Government's directives in Resolution No. 28/NQ-CP dated March 5, 2024, and other relevant directives of the Prime Minister; promptly and strictly handle violations in accordance with the law if they fail to comply or intentionally refuse to comply.

c) Continue to preside over and coordinate with the Ministry of Industry and Trade and key petroleum trading businesses to review and decide on adjustments to related costs in the formula for calculating the base price of petroleum products in accordance with the regulations in the Decrees on petroleum business and relevant legal regulations, closely following developments in the world petroleum market and the production and business activities of enterprises.

3. The Minister of Information and Communications shall closely coordinate with the Ministers of Industry and Trade and Finance to direct press agencies and cooperate with Vietnam Television, Vietnam Radio, and Vietnam News Agency to provide official and timely information on the policies and directives of the Government and ministries, sectors, and localities regarding the management and operation of petroleum products, ensuring the supply of petroleum products, and implementing legal regulations on electronic invoices to create public consensus and avoid disseminating inaccurate information that could destabilize the market. The Ministries of Industry and Trade and Finance shall proactively and promptly provide information to the Ministry of Information and Communications and press agencies as prescribed.

4. The Chairman of the State Capital Management Committee at Enterprises shall closely coordinate with the Ministry of Industry and Trade to direct the Vietnam National Petroleum Group and the Vietnam National Petroleum Group to immediately implement the issuance of electronic invoices at retail gasoline stations for customers for each sale at retail gasoline stations and provide electronic invoice data as prescribed and connect with tax authorities through digital transformation; develop appropriate, scientific, and effective plans for the production, storage, distribution, and regulation of petroleum products to ensure there is no shortage of petroleum supply to the market.

5. The National Steering Committee 389, the Ministers of the Ministries of Industry and Trade, Finance, Public Security, the Government Inspectorate, the Chairpersons of the People's Committees of provinces and centrally-administered cities, and the heads of relevant agencies, according to their assigned functions and duties, shall strengthen inspection and supervision to promptly detect, prevent, and strictly handle, in accordance with the law, acts of hoarding, smuggling of petroleum products across borders, commercial fraud, violations of regulations on petroleum business, regulations on electronic invoices, etc.; continue to closely monitor petroleum business activities (petroleum quality, sales hours, retail prices, use of the Petroleum Price Stabilization Fund, etc.); and at the same time create favorable conditions for traders to conduct business, transportation, circulation, and distribution of petroleum products, and ensure security, order, and social safety in the area as prescribed.

6. The Chairpersons of the People's Committees of provinces and centrally-administered cities shall strengthen the direction of local departments and agencies to closely coordinate with functional agencies on Taxation, Public Security, Industry and Trade, and other relevant agencies to promote management, inspection, supervision, detection, and strict handling of violations, non-compliance, or deliberate non-compliance of regulations on electronic invoices connected to tax authorities through digital transformation for retail gasoline and diesel fuel activities in the locality, in accordance with the Government's directives in Resolution No. 28/NQ-CP dated March 5, 2024, and the Prime Minister's directives in Official Telegrams No. 1123/CĐ-TTg dated November 18, 2023, and No. 1284/CĐ-TTg dated December 1, 2023.

7. The Chairpersons and General Directors of the following corporations and enterprises: Vietnam Oil and Gas Group, Vietnam Petroleum Group, Binh Son Refinery and Petrochemical Company, and Nghi Son Refinery and Petrochemical Company shall proactively develop production plans, business plans, and ensure safe, stable, and efficient operation of their plants; closely monitor the global and domestic petroleum market situation; proactively and promptly handle any arising situations within their authority; and report to higher authorities if the situation exceeds their authority, ensuring sufficient petroleum supply to the market according to the plan approved by the competent authority and the provisions of the law.

8. The Vietnam Petroleum Association will strengthen its efforts to inform its members about developments in the global petroleum market, ensuring accurate and timely information to guide the business activities of petroleum traders. Members will be instructed to strictly and fully comply with the rights, obligations, responsibilities, and business ethics stipulated in the Decrees on petroleum business and other relevant legal regulations, especially the strict, complete, and timely implementation of regulations on electronic invoices connected to the tax authorities for petroleum business activities, in accordance with the directives of the Government and the Prime Minister.

9. The Government Office shall monitor and supervise according to its assigned functions and tasks; and promptly report to the Prime Minister any issues arising that are beyond its authority.
