(Chinhphu.vn) - The criteria for selecting Vietnamese organizations and enterprises to be assigned tasks or commissioned to receive technology transfer for railway projects have just been specified in detail in Government Decree No. 319/2025/ND-CP.

Regarding the criteria for selecting Vietnamese organizations and enterprises to be assigned or commissioned to receive technology transfer for railway projects, the Decree stipulates that: Vietnamese organizations and enterprises are assigned or commissioned to receive technology transfer for railway projects when they simultaneously meet the following criteria:

a) Being an organization or enterprise established in accordance with Vietnamese law;

b) Having clear functions and responsibilities (for organizations) or registered business lines and operating licenses (for enterprises) that are consistent with the technology field being transferred;

c) Having workshops and facilities of sufficient scale to meet the requirements for receiving and installing machinery, equipment, and technological lines;

d) Having sufficient financial resources or the ability to mobilize financial resources to cover and settle the costs of technology transfer;

d) Having a team of experts, technical staff, and workers with management and research capabilities, as well as professional and technical qualifications, to ensure the reception, mastery, and operation of the transferred technology;

e) There is a plan to mobilize resources to meet the requirements for receiving technology transfer;

g) There is a commitment to ensure the completion of the acquisition, mastery, and operation of the transferred technology;

h) Having experience in international cooperation on technology transfer;

i) Not currently undergoing dissolution procedures or having its business registration certificate or business license revoked; not subject to insolvency as defined by bankruptcy law;

k) The technology transfer price does not exceed the estimated cost of technology transfer in the railway project that has been approved by the competent authority.

The decree states that the railway project investor shall determine the specific requirements for the criteria stipulated above, ensuring they are consistent with the type of technology transferred to serve the railway project.

Procedures and authority for selecting Vietnamese organizations and enterprises to be assigned tasks or commissioned to receive technology transfer for railway projects.

The decree stipulates that the investor of a railway project shall submit specific requests regarding the criteria for selecting Vietnamese organizations and enterprises to be assigned tasks or commissioned to receive technology transfer as prescribed above to the Ministry of Construction and the People's Committee of the province (for local railway projects).

The Ministry of Construction and the People's Committees of provinces (for local railway projects) shall announce on their electronic portals and through mass media the selection of organizations and enterprises assigned the task or commissioned to receive technology transfer for railway projects.

Organizations and businesses must submit one set of documents to participate in the selection process for task assignment or technology transfer, either directly, via postal service, or electronically, to the Ministry of Construction or the Provincial People's Committee (for local railway projects).

If the application dossier does not meet the requirements, within 3 working days from the date of receipt, the Ministry of Construction or the Provincial People's Committee shall send a written notice to the organization or enterprise requesting amendments and supplements to the dossier; the deadline for amendments and supplements shall not exceed 7 working days from the date of receipt of the written notice from the Ministry of Construction or the Provincial People's Committee. If the amended and supplemented dossier still does not meet the requirements, within 3 working days from the date of receipt of the amended and supplemented dossier, the Ministry of Construction or the Provincial People's Committee shall send a written notice stating that the organization or enterprise's dossier is not eligible for consideration and evaluation.

Within no more than 30 days from the date of receiving complete dossiers as prescribed, the Ministry of Construction and the People's Committee of the province (for local railway projects) shall decide to establish an advisory council to evaluate whether the organization or enterprise meets the prescribed criteria.

Within 20 days of the establishment decision, the Advisory Council is responsible for completing the evaluation of the results of the technology transfer implementation.

Within 15 days of receiving the opinions of the Advisory Council, the Ministry of Construction and the People's Committee of the province (for local railway projects) shall decide on the selection of Vietnamese organizations and enterprises to be assigned the task or commissioned to receive technology transfer for the railway project.
