According to AFP news agency, on July 14, in an unsigned order, the US Supreme Court canceled the suspension order of mass layoffs at the US Department of Education issued by a federal judge earlier.
US President Donald Trump pledged during his election campaign to abolish the US Department of Education, an agency created by an act of Congress in 1979.
In March, Mr. Trump moved to cut nearly half of the department’s staff. He also instructed Education Secretary Linda McMahon to “resign herself.”
About 20 states and teachers unions have filed a lawsuit, accusing President Trump of violating the separation of powers principle by encroaching on the authority of Congress.
In May, Myong Joun district judge ordered the reinstatement of hundreds of fired Education Ministry employees.
The US Supreme Court overturned Judge Joun’s order without giving any reason. However, it was a divided decision, with three of the nine justices dissenting.
Justice Sonia Sotomayor, in a dissent joined by Justices Elena Kagan and Ketanji Brown Jackson, stressed that "only the US Congress has the power to dissolve the Department of Education."
"The majority (of the court's justices - Editor's note) is either willfully ignorant of the implications of this decision, or is naive. Either way, the threat to the separation of powers principle in our Constitution is very serious," Ms. Sotomayor noted.
In reality, the federal government 's role in education in the United States is very limited, with only 13% of the federal budget going to public schools, the rest coming from state and local governments.
However, this federal funding is critical for schools in low-income areas and students with special needs. At the same time, the federal government plays a vital role in enforcing civil rights protections for students.
