Supreme Court allows Trump to continue dissolving US Department of Education

The US Supreme Court has given President Donald Trump the green light to continue his plan to dissolve the US Department of Education. However, this was a decision that was very divided in the court.

According to AFP, on July 14, in an unsigned order, the US Supreme Court overturned a federal judge's earlier injunction suspending a plan for mass layoffs at the US Department of Education.

US President Donald Trump pledged during his election campaign that he would dissolve the US Department of Education – an agency established by an act of Congress in 1979.

In March, Trump took steps to cut nearly half of the department's staff. He also instructed Education Secretary Linda McMahon to "quit herself."

Approximately 20 states and teachers' unions have filed lawsuits, alleging that President Trump violated the principle of separation of powers by encroaching on the authority of Congress.

In May, District Judge Myong Joun ordered the reinstatement of hundreds of dismissed Ministry of Education officials.

The U.S. Supreme Court overturned Justice Joun's order without giving a reason. However, this was a divisive decision, with three out of nine justices opposing the ruling.

Justice Sonia Sotomayor, in an opposing opinion joined by Justices Elena Kagan and Ketanji Brown Jackson, stressed that "only the U.S. Congress has the authority to dissolve the Department of Education."

"The majority (of the judges) are either deliberately ignoring the implications of this ruling, or are simply too naive. Either way, the threat to the principle of separation of powers in our Constitution is very serious," Sotomayor noted.

In reality, the federal government 's role in education in the US is very limited, with only 13% of federal funding for public schools, the rest coming from state and local governments.

However, this portion of federal funding is crucial for schools in low-income areas and students with special needs. At the same time, the federal government plays a vital role in enforcing civil rights protections for students.
