The Government has just issued Decree 261/2025/ND-CP amending and supplementing a number of articles of Decree No. 100/2024/ND-CP dated July 26, 2024, detailing a number of articles of the Law on Housing on the development and management of social housing, and Decree No. 192/2025/ND-CP dated July 1, 2025, of the Government detailing a number of articles and measures for implementing Resolution No. 201/2025/QH15 dated May 29, 2025, of the National Assembly on piloting a number of specific mechanisms and policies for the development of social housing. The Decree takes effect from the date of issuance (October 10, 2025).
The decree has amended the income requirements for social housing buyers. Specifically, if the applicant is unmarried or confirmed as single, their average monthly net income must not exceed 20 million VND, based on the wage and salary table certified by the agency, unit, or enterprise where the applicant works.
In cases where the applicant is unmarried or certified as single and raising minor children, their average monthly net income must not exceed 30 million VND, calculated according to the wage and salary table certified by the agency, unit, or enterprise where the applicant works.
In cases where the applicant is legally married, the applicant and their spouse must have a combined average monthly income of no more than 40 million VND, based on the wage and salary table certified by the agency, unit, or enterprise where the applicant works.
The period for determining income eligibility as stipulated in points a and b of this clause is within 12 consecutive months, calculated from the time the competent authority makes the confirmation.
Based on the conditions and income levels of each area within the province, the housing incentive policies for officials, civil servants, and public employees, and the number of dependents as stipulated by law, the Provincial People's Committee may decide on the adjustment coefficient for the income level specified in points a and b of this clause, but not exceeding the ratio between the average per capita income in the locality and the average per capita income of the whole country; and decide on policies to encourage access to social housing for those eligible for social housing support policies who have three or more dependents in the same household.
In the case of individuals specified in Clause 5, Article 76 of the Housing Law who do not have an employment contract, they must meet the income requirements stipulated in Clause 1 of this Article and have their income confirmed by the commune-level police agency where they reside permanently, temporarily, or currently. Within 7 days from the date of receiving the request for confirmation, the commune-level police agency where the individual resides permanently, temporarily, or currently resides will verify the income requirements based on information from the population database.
Regarding interest rates for loans to rent or purchase social housing, the Decree stipulates an interest rate of 5.4% per year. The interest rate for overdue payments is 130% of the lending interest rate. If necessary, the Social Policy Bank shall take the lead, in coordination with the Ministry of Construction and other relevant agencies, to submit a proposal to the Prime Minister for consideration and decision.
For loans for which credit agreements were signed with the Social Policy Bank to purchase or lease-purchase social housing, housing for the armed forces, or to build, renovate, or repair housing before the effective date of this Decree, the credit agreements may be adjusted to apply the interest rate stipulated in Clause 4, Article 1 of this Decree to the actual principal balance and any overdue principal balance (if any).
