The Government has just issued Decree 261/2025/ND-CP amending and supplementing a number of articles of Decree No. 100/2024/ND-CP dated July 26, 2024 detailing a number of articles of the Housing Law on the development and management of social housing and Decree No. 192/2025/ND-CP dated July 1, 2025 of the Government detailing a number of articles and measures to implement Resolution No. 201/2025/QH15 dated May 29, 2025 of the National Assembly on piloting a number of specific mechanisms and policies for the development of social housing. The Decree takes effect from the date of promulgation (October 10, 2025).
The Decree has amended the income conditions for social housing buyers. Specifically, in case the applicant is not married or is confirmed to be single, the average monthly income received must not exceed 20 million VND calculated according to the Wage and Salary Table confirmed by the agency, unit or enterprise where the applicant works.
In case the applicant is unmarried or confirmed to be single and raising a child under the age of majority, the average monthly income received shall not exceed 30 million VND calculated according to the Wage and Salary Table confirmed by the agency, unit or enterprise where the applicant works.
In case the applicant is married according to the provisions of law, the applicant and his/her spouse must have a total average monthly income of no more than 40 million VND calculated according to the Wage and Salary Table confirmed by the agency, unit or enterprise where the applicant works.
The time limit for determining income conditions as prescribed in Point a and Point b of this Clause is within 12 consecutive months, calculated from the time the competent authority makes the confirmation.
Based on the conditions and income levels of each area in the locality, preferential housing policies for cadres, civil servants, public employees, and the number of dependents according to the provisions of law, the Provincial People's Committee shall decide on the coefficient for adjusting the income level prescribed in Point a and Point b of this Clause, but not exceeding the ratio between the average income per capita in the locality and the average income per capita of the whole country; decide on policies to encourage access to social housing for beneficiaries of social housing support policies with 3 or more dependents in the same household.
In case the subject specified in Clause 5, Article 76 of the Housing Law does not have a Labor Contract, he/she must ensure the income conditions as prescribed in Clause 1 of this Article and be confirmed by the commune-level police agency at the place of permanent or temporary residence or current residence. Within 7 days from the date of receipt of the request for confirmation, the commune-level police agency at the place of permanent or temporary residence or residence at the time the subject requests confirmation shall, based on the information in the population database, confirm the income conditions.
Regarding the interest rate for loans for renting or buying social housing, the Decree stipulates that the loan interest rate is 5.4%/year. The overdue debt interest rate is 130% of the loan interest rate. In case it is necessary to change the loan interest rate, the Vietnam Bank for Social Policies shall preside over and coordinate with the Ministry of Construction and relevant agencies to submit to the Prime Minister for consideration and decision.
For loans that have signed a credit contract with the Social Policy Bank to purchase, hire-purchase social housing, housing for the people's armed forces, build or renovate, repair housing before the effective date of this Decree, the credit contract shall be adjusted to apply the interest rate as prescribed in Clause 4, Article 1 of this Decree for the actual principal balance and overdue principal balance (if any).
