What are the 38 conditional investment and business sectors that have been abolished?

On December 11-12, the National Assembly voted to pass the Investment Law, which reviewed and reduced 38 conditional investment and business sectors and amended and simplified 20 sectors.

The list includes 38 sectors that will be cut back, mainly in the service industry.

Accordingly, 38 conditional investment and business sectors have been reduced, including tax procedures; customs procedures; insurance auxiliary services; commercial inspection services; temporary import and re-export of goods subject to excise tax; temporary import and re-export of frozen food; temporary import and re-export of used goods; energy auditing; and employment services.

Business activities include: labor leasing services; automobile warranty and maintenance services; shipbuilding, conversion, repair, and restoration services for inland waterway vessels; maritime safety services; ship towing services; shipbuilding, conversion, and repair services; air traffic control services; multimodal transport services; and architectural services.

Construction activities by foreign contractors; construction investment cost management services; apartment building management and operation services; crematorium management and operation services; data center services; study abroad consulting services.

Raising common forest animals; breeding and cultivating wild plant and animal species listed in the Appendices of the CITES Convention and the list of endangered, rare, and precious forest plants, animals, and aquatic species; importing, exporting, re-exporting, transiting, and importing from the sea specimens from nature of species listed in the Appendices of the CITES Convention.

Export, import, and re-export of specimens of bred, raised, and artificially cultivated species listed in the Appendices of the CITES Convention and the list of endangered, rare, and precious forest plants, animals, and aquatic species.

Processing, trading, transporting, advertising, displaying, and storing specimens of plant and animal species covered by the convention;

Food business falls under the specialized management of the Ministry of Agriculture and Rural Development ; animal and animal product quarantine services; cosmetic surgery services; inspection, calibration, and testing services for measuring instruments and measurement standards; performing arts services, fashion shows, and beauty and model contests.

Business activities include: construction services for information technology infrastructure, development of software for land information systems; construction services for land databases; printing and minting of money; and archiving services.

Simplify and revise 20 professions.

Review and revise the scope of 20 sectors and professions. This includes the professions of "practicing forensic expertise in the fields of finance, banking, construction, antiques, artifacts, and copyright"; "practicing bailiff services"; and "business of registration, custody, clearing and settlement services of securities by the Vietnam Securities Depository and Clearing Corporation, organizing the trading market for listed securities and other types of securities".

Amend the regulations on business sectors and occupations to include: "Trading in chemicals, excluding prohibited chemicals; Trading in tobacco products, tobacco raw materials, machinery and equipment related to the tobacco industry; trading in food products under the specialized management of the Ministry of Industry and Trade and the Ministry of Agriculture and Rural Development";

Amendments to the business sectors and occupations : "E-commerce activities"; airport and airfield business; aviation services business at airports and airfields; changing the names of the business sectors to replace the phrase "business" with "professional practice" for the following services: investment project management consulting; construction surveying; design and design verification; construction supervision consulting; construction work; construction inspection; and preparation of construction planning designs.

Narrowing the scope of the "Printing Services Business" sector to exclude "printing of packaging without product labels"; amending the sector and profession "processing, recycling, repairing, and refurbishing services for used information technology products included in the List of Used Information Technology Products Prohibited from Import for Foreign Partners".

Other business activities subject to amendment include: trading in aquatic feed and animal feed; trading in testing services for aquatic feed and animal feed; trading in biological products, microorganisms, chemicals, and environmental treatment substances in aquaculture and animal husbandry; trading in aquatic animal breeds; and trading in medical equipment.

In addition, there are business sectors providing intellectual property rights representation services (including industrial property representation services and plant variety rights representation services); providing payment intermediary services, providing payment services without using customers' payment accounts; gold trading...

According to the Government, based on the proposed reductions, cuts, and amendments to conditional investment and business sectors as mentioned above, the Government will instruct relevant ministries and agencies to urgently study management methods based on regulations and standards for the sectors proposed for reduction or amendment.

The goal is to shift strongly from "pre-approval" to "post-approval," from "licensing" to "registration" or "notification," towards management primarily based on regulations and standards, with important and necessary contents requiring state management and regulation.
