Ensuring the rights of students and teachers after the decision to suspend the operations of the American International School (Nha Be district)

On July 2nd, the Ho Chi Minh City Department of Education and Training announced that it had decided to suspend operations at the American International Primary, Secondary, and High School (Nha Be District, Ho Chi Minh City).

Accordingly, the Ho Chi Minh City Department of Education and Training and the inter-agency task force held a meeting with the investor and the board of directors of the American International School of Primary, Secondary and High School (AISVN) on May 28, 2024.

At the meeting, the Ho Chi Minh City Department of Education and Training requested the investor and the school board to submit a report to the Department of Education and Training before June 15, 2024 (the report should include supporting evidence demonstrating compliance with the educational operating conditions stipulated in the 2019 Education Law and a comprehensive report on the payment of debts to tax authorities, social insurance, salaries for teachers and staff, and other educational services).

However, after June 15, 2024, the Ho Chi Minh City Department of Education and Training had not received a report from the school to determine whether the American International Primary, Secondary, and High School met the requirements for educational operation according to the 2019 Education Law and Decree 46/2017/ND-CP.

Therefore, based on the provisions of point b, clause 1, Article 50 of the 2019 Education Law and point b, clause 1, Article 30 of Government Decree No. 46/2017/ND-CP, due to not meeting the conditions for permission to operate educational activities, specifically lacking sufficient financial resources as prescribed to ensure the maintenance and development of educational activities; and having insufficient educational management staff to implement the educational program and organize educational activities; the Ho Chi Minh City Department of Education and Training issued Decision No. 2042/QD-SGDĐT (dated June 28, 2024) on suspending the school's educational activities.

The suspension period is 12 months, starting from July 1, 2024.

In order to ensure the legitimate rights and interests of students, the Ho Chi Minh City Department of Education and Training is urgently implementing solutions to address and resolve issues following the suspension of operations at the American International Primary, Secondary, and High School.

Accordingly, the Department of Education and Training has worked with 18 high schools that have invested in and teach foreign curricula to assess their capacity to receive students and the policies to support students who wish to transfer from American International Schools.

Specifically for schools teaching the International Baccalaureate (IB) program, the capacity to accommodate students in the 2024-2025 school year in the city is 1,251 places, more than the number of students currently studying at the American International Primary, Secondary, and High School.

To date, according to reports from educational institutions, there have been 134 cases of parents transferring their children from the American International Primary, Secondary, and High School.

According to the guidelines of the Ho Chi Minh City Department of Education and Training, students in grades 1, 2, 3, 4, 5, 6, 7, and 8 in the 2023-2024 school year can transfer to public and private secondary schools teaching the Ministry of Education and Training's general education program; schools implementing integrated programs; and schools with foreign investment teaching the International Baccalaureate (IB) program.

Specifically, students in grades 9, 10, and 11 in the 2023-2024 school year can register to transfer to private high schools that teach integrated programs; or schools with foreign investment that teach foreign programs or the International Baccalaureate (IB) program.

In addition, the Ho Chi Minh City Department of Education and Training requires the American International Education Joint Stock Company and the American International Primary, Secondary, and High School to take responsibility for students, teachers, educational administrators, and staff based on their obligations and responsibilities regarding the legitimate rights and interests of students, teachers, educational administrators, and staff.

Specifically, for students, appropriate solutions need to be implemented to ensure their right to education, preventing any disruption to their studies; and solutions to stabilize the psychological well-being of students and their parents.

For teachers, administrators, and staff, it is necessary to ensure the implementation of policies and regulations (salary, allowances, social insurance, health insurance, unemployment insurance) as agreed with employees in the signed labor contracts; and to fully comply with regulations on the employment of foreign workers in accordance with the law.
