According to the draft Decree on land use and lease fees to remove obstacles in implementing the Land Law.
Specifically, when households and individuals convert agricultural land to residential land within the limit, they only have to pay 30% of the difference between the price of residential land and agricultural land.
For the part that exceeds the limit but not more than once, people will pay 50% of the difference. If the part exceeds the limit once, the amount to be paid is the entire difference between the current price of agricultural land and residential land.
This preferential policy is only applied once for households and individuals. Subsequent conversions will require a 100% fee difference.
Previously, when converting agricultural land to residential land, people only paid land use fees calculated as a percentage of the difference between residential land price and agricultural land price. The fee was 30% for areas within the limit and 50% for areas exceeding the limit. Thanks to that, many households, especially in rural or suburban areas, can easily convert garden land and ponds adjacent to houses to residential land at a reasonable cost.
Since the 2024 Land Law was implemented, this provision has been abolished. People must pay the full difference between the price of agricultural land and residential land. They no longer receive the same discount as before, even if the land has long had houses on it.
In addition, many localities have petitioned the Ministry of Finance to increase the new land price list in the area, leading to an increase in land use fees that people have to pay, in some cases many times higher than before. This makes it difficult for many families to legalize residential land, especially when the demand for separating households and building new houses is still very high.
This is an urgent issue directly related to social security and people's housing needs. The Ministry of Finance believes that it is necessary to soon have a policy to resolve it before the 2024 Land Law is amended.
The draft resolution is expected to be submitted for approval in September and take effect from the date of signing until February 28, 2027.
Previously, at a meeting in early August, Deputy Prime Minister Tran Hong Ha requested to amend the regulations on land use fees in a fair and lenient manner for the people, avoiding difficulties when amending the Land Law. He emphasized the view that the collection when changing land use purposes must have a clear basis, in which the reason for collection and reduction must be clarified. At the same time, he requested to distinguish responsibilities between the State and enterprises and avoid wasting land resources.
