Proposal for Hanoi to be compensated for resettlement projects twice as much as prescribed

On the morning of December 8, Minister of Finance Nguyen Van Thang, authorized by the Government, submitted to the National Assembly a draft resolution on specific mechanisms and policies to implement major projects in the capital.

According to the Minister of Finance, Hanoi is implementing a large number of key projects, including public investment projects, public-private partnership (PPP) investment projects, projects to attract strategic investors, and projects to renovate and beautify urban areas and rebuild old apartment buildings.

To facilitate the implementation of the above-mentioned large-scale, key projects, especially extremely large-scale projects, the issuance of a Resolution allowing Hanoi to pilot a number of specific mechanisms and policies is necessary and urgent, in order to clear legal bottlenecks and attract investment.

The draft Resolution stipulates a pilot special mechanism for public investment projects, PPP investment projects that meet the criteria of important national projects; projects using local budget capital, legal local capital sources in the city with a total investment of VND30,000 billion or more.

Minister of Finance Nguyen Van Thang explained the contents of concern to National Assembly deputies regarding the draft Resolution on special mechanisms and policies for implementing large projects in the capital.

The Draft Resolution is built with 7 groups of specific mechanisms and policies to implement large and important projects in the capital, including: Authority to decide and approve investment policies; Selection of investors and contractors; Planning and architecture; Land recovery, land allocation and land lease; Mechanism for capital mobilization to implement projects; Measures to ensure urban order, social order and safety; and Measures for urban renovation, embellishment and reconstruction.

In particular, in the content of land recovery, land allocation, land lease, to increase the initiative in land recovery, create resources for implementation, payment mechanism for BT projects, speed up the progress of large and important projects, the drafting agency proposed to double the compensation, support and resettlement levels compared to the regulations in projects that need to be implemented immediately under the direction of the Politburo , the Central Party Secretariat, the Government Party Committee; in other cases, based on reality and the city's budget balancing capacity, the City People's Council decides on the compensation, support and resettlement levels higher than the regulations but not more than 2 times.

Decide by coefficient K?

Agreeing with the proposal to have a policy of adequate compensation for people when implementing important projects, however, delegate Hoang Van Cuong (Hanoi delegation) said that the compensation level should not be set at twice the prescribed level. Because the prescribed level is decided by the city itself according to the coefficient K at each location multiplied by the land price list.

"If compensation is required, the city will decide on the coefficient K. Furthermore, the Capital Law also stipulates that the city will decide on compensation and support policies for people when renovating and beautifying the urban area," Mr. Cuong stated.

Sharing the same view, delegate Trinh Xuan An (Dong Nai delegation) said that through reviewing resolutions on special mechanisms being applied in many localities, we have allowed provinces to apply land price tables and coefficients K.

According to Mr. An, if the "double" regulation is included in Hanoi's resolution, in some cases, this level may be lower or limit the locality's initiative, because when multiplying the coefficient K, the price can reach 3-4 times, even 5 times if suitable for reality.

"Therefore, I suggest that we should not impose a strict price twice, but rather let the city apply the price list and coefficient K to suit reality, ensuring harmony between the interests of the people and the State," Mr. An suggested.

In the draft Resolution on land allocation in cases where land prices are not yet available, delegate An suggested closely reviewing this regulation to ensure legal safety and feasibility during implementation.

According to the analysis of the delegates, the reality shows that land prices can only be determined after the completion of the counting, approval and settlement work. If land is mortgaged for loans without a specific price, it will create great risks, causing difficulties for credit work as well as settlement.

Regarding the resource mobilization mechanism, the draft only mentions credit, which according to the delegate is too narrow because credit relations are only part of the financial picture. The delegate suggested expanding the scope to bonds, investment funds and other legal forms of capital mobilization, and only stipulating general principles.

"Specific negotiations with banks or financial institutions will be carried out by the city and investors. Broader regulations will create flexible space to attract social resources," said Mr. An.
