On the morning of December 8, Minister of Finance Nguyen Van Thang, authorized by the Prime Minister, submitted to the National Assembly a draft resolution to pilot a number of specific mechanisms and policies to implement large and important projects in the capital.
The implementation of renovation of old apartments and urban beautification in Hanoi still has many shortcomings and delays.
According to the draft, large and important projects in the capital include public investment projects, PPP projects, and projects that need to be implemented immediately under the direction of the Politburo , Secretariat, Government Party Committee, and Hanoi Party Executive Committee.
There are also projects that meet important national criteria; projects using local budgets or in the list of attracting strategic investors with a total investment of 30,000 billion VND or more.
Project to handle traffic congestion, flooding; environmental pollution; project to renovate old apartment buildings, and urban reconstruction.
Notably, the draft stipulates measures to renovate, embellish and rebuild urban areas.
The Government's report clearly stated that reality shows that the implementation of the renovation of old apartment buildings and urban beautification in Hanoi still has many shortcomings and delays, affecting the safety and lives of the people.
To overcome the above situation, the draft resolution stipulates that the City People's Committee decides on measures to renovate, embellish and rebuild urban areas:
Demolition of apartment buildings and condominiums that must be demolished according to housing law; renovation, refurbishment, and reconstruction of an urban block or many urban blocks.
Assign the investor to carry out the detailed planning of the urban area renovation, embellishment and reconstruction project and submit it to the competent authority for approval.
The competent authority approving the planning is allowed to decide on planning, architectural and population indicators for projects in the historical inner city area that exceed the regulations in the general planning and urban zoning planning on the basis of the overall population balance according to the planning but must ensure the indicators on social infrastructure, technical infrastructure and infrastructure connection of the area.
Based on the decision of the City People's Council, the City People's Committee decides on the plan to renovate and rebuild the apartment complex after conducting an inspection and assessment of the apartment building's representatives and determining that it is subject to demolition, it is not necessary to inspect and assess the entire apartment complex.
According to the draft, the City People's Committee decides to take enforcement measures in cases where the investor has received consensus from more than 75% of homeowners and land users equivalent to at least 75% of the area of the urban area for renovation, refurbishment, and reconstruction on the planning, compensation, support, and resettlement plan.

Without this mechanism, it is impossible to renovate old, degraded and unsafe apartment buildings.
After the discussion, delegate Hoang Van Cuong (Hanoi) agreed with the provisions in the draft on measures to renovate, embellish and rebuild urban areas when more than 75% of homeowners and users of 75% of the land area in the renovated area agreed.
At the same time, it is allowed to decide on planning, architecture and population indicators.
According to him, without this mechanism, it is impossible to renovate old, degraded, unsafe apartment buildings, or self-built, crowded houses with no escape routes in case of fire or explosion.
He said this mechanism will allow for the comprehensive renovation of both old apartment buildings and low-rise buildings into modern, civilized urban areas.
"Developing the space above ground is for residential purposes; the entire underground space is for business, services and underground transportation. The space above ground is for greenery and public space.
"It is necessary to stipulate that urban regeneration areas with increased population density must follow the TOD model. Above are high-rise buildings, below must be subway stations and underground space for service development," he said.
He suggested reviewing the planning of historic inner-city areas to include only areas that need to be preserved and maintain historical values.
Such as Ba Dinh area, West Lake and Old Quarter area. High-rise buildings are not allowed in these areas so population density cannot be increased.
He said that the planning of both Hai Ba Trung and the old Dong Da districts, where there are many old apartment buildings and low-rise buildings that need to be renovated, into the historic inner city area has many shortcomings.
Accordingly, not only are they tying themselves up to have to ask for a mechanism for renovation today, but they are also tying up people in this area to have difficulty renovating and building houses "because it is located in a historic inner city area".
Delegate Trinh Xuan An (Dong Nai) said that the draft stated that if there is a consensus of over 75%, enforcement will be carried out, but he proposed that with old apartment buildings, enforcement would only be carried out if there is only over 50%. Then there will be an impact assessment to clearly see that this is good for the people, and leaving it at 75% is a bit high.
Only applies to old, dangerous apartment buildings with over 75% of residents agreeing.
Delegate Nguyen Truc Anh, a member of the Economic and Financial Committee, also supported the proposal of delegate Trinh Xuan An to reduce the consensus rate. He considered the 75% rate to be high and some countries only apply the consensus rate of 50%.
Explaining this further, Minister of Finance Nguyen Van Thang said that the regulation allowing the Hanoi People's Committee to decide on enforcement measures in cases where the investor has received the consent of more than 75% of homeowners and land users equivalent to at least 75% of the area of the urban renovation, refurbishment and reconstruction area is very necessary to protect people's lives and speed up project progress.
According to the minister, this measure is only applied to old and dangerous apartment buildings and has been agreed by over 75% of the people and after the city has made the greatest effort to provide satisfactory compensation, support and resettlement. At the same time, all steps of propaganda, mobilization and persuasion have been fully implemented.
The minister stated that "having to enforce the law as a last resort must comply with legal regulations such as having a resettlement plan and publicly posting the decision...
"This policy is expected to help the city have more tools to implement urban beautification," Mr. Thang stated.
