Design the right incentives
On the morning of December 8, continuing the 10th session, under the direction of Vice Chairman of the National Assembly Nguyen Duc Hai, National Assembly deputies discussed in the hall the draft Resolution of the National Assembly on specific mechanisms and policies to implement major projects in the capital; the draft Resolution of the National Assembly amending and supplementing a number of articles of Resolution No. 98/2023/QH15 on piloting a number of specific mechanisms and policies for the development of Ho Chi Minh City; the draft Resolution of the National Assembly amending and supplementing a number of articles of Resolution No. 136/2024/QH15 on the organization of urban government and piloting a number of specific mechanisms and policies for the development of Da Nang City.

Deputies emphasized the urgent need for a superior and proactive institutional framework to remove bottlenecks in planning, land, and resource mobilization, thereby creating new growth momentum for the whole country.
Many opinions focus on decentralization and strong delegation of power to local authorities, allowing them to pilot mechanisms such as the TOD model (urban development model with public transport system as the center) and building free trade zones, considering this as a "test" of enforcement capacity and an opportunity to perfect the national legal system.
Explaining and clarifying some contents of the National Assembly's draft resolutions on specific mechanisms and policies related to the localities of Hanoi, Ho Chi Minh City, and Da Nang, Minister of Finance Nguyen Van Thang said that the opinions will be seriously received by the drafting committee for complete revision, in order to create conditions for localities to promote their advantages.
Regarding the exploitation of land funds from TOD projects in the above three localities, Minister Nguyen Van Thang stated that localities need to issue criteria and standards to ensure strict technical safety, strictly comply with the construction safety corridor and a separate licensing mechanism for construction activities within the protection area of railway works.
"This policy approach of the draft resolution is completely similar to the requirements in Article 210 and Clause 2, Article 218 of the Land Law on safety corridors and multi-purpose land use," said Minister Nguyen Van Thang.

In the draft resolution, allowing 2 cities (HCMC and Da Nang) to use 100% of the revenue from land funds, according to Mr. Nguyen Van Thang, is to unify the application of the law. At the same time, the regulation also creates conditions for localities to ensure resources to focus on implementing railway projects and TOD projects.
"In the draft, the ministry has designed appropriate incentives, ensuring a full and flexible legal corridor for localities in selecting investors with financial capacity and modern management technology, contributing to the formation of large-scale projects with spillover effects and promoting the process of economic restructuring towards services, industry and high technology," said the head of the Ministry of Finance.
Previously, some National Assembly deputies proposed that Ho Chi Minh City should also have a master plan like Hanoi, and at the same time decentralize and authorize the City People's Committee to adjust and approve the plan. With this opinion, Mr. Nguyen Van Thang said that although this "model" is a breakthrough, it must be ensured that it is piloted step by step, accompanied by inspection and supervision to limit risks. After the pilot, it will be summarized and evaluated before applying it to other localities.
On the same morning, some delegates of Ho Chi Minh City proposed that there is currently no salary table and that the application of social security policy should be to pay an average income increase of no more than 0.8 times the basic salary fund. "We would like to accept and recommend that the National Assembly include this content in the draft joint resolution at the 10th session of the 15th National Assembly," said Mr. Nguyen Van Thang.
"Superior" mechanism for the capital
Minister Nguyen Van Thang also said that the draft resolution focuses on removing and simplifying procedures for 5 groups of large and important projects for Hanoi: public investment projects, PPP investment projects, investment projects that need to be implemented immediately under the direction of competent authorities; public investment projects, PPP projects that meet the criteria of important national projects using local budget capital with a total investment of 30,000 billion VND or more; investment projects in the list of projects attracting strategic investors according to the provisions of law on the capital with a total investment of 30,000 billion VND or more...
Regarding land recovery, according to the Minister, in reality, important large projects in Hanoi often have very diverse land use purposes, including sports land, cultural land, commercial land, housing, and projects that do not fall under the land recovery cases prescribed in Article 79 of the Land Law or current resolutions to remove obstacles.
Therefore, according to Mr. Nguyen Van Thang, applying the listing method according to current law does not ensure completeness and will certainly miss out on projects of international, national and regional scale that may arise in the near future.
