Proposal that if hydroelectric dams release floodwaters causing damage to people, appropriate compensation must be paid

On the afternoon of December 8, National Assembly deputies discussed in the hall the draft Resolution of the National Assembly on mechanisms and policies for national energy development in the 2026-2030 period.

Commenting on the draft Resolution of the National Assembly on the mechanism and policy for national energy development in the period of 2026 - 2030, Deputy Nguyen Anh Tri (Hanoi) said that the draft has regulations on planning, investment in construction of power projects, development of offshore wind power, electricity trading, oil and gas, investment in construction of investment projects, but does not mention hydropower - a very important content.

Regarding small and medium hydropower plants and the consequences of flood discharge, Deputy Nguyen Anh Tri acknowledged that electricity development must be safe and not cause harm to the environment, national security and defense, people's lives and human lives. Deputy Nguyen Anh Tri emphasized the importance and urgency of mentioning hydropower in the draft resolution, especially planning and measures to limit the harmful effects of small and medium hydropower plants.

“I see that we have not really paid due attention to small and medium hydropower plants, especially the safety of people and the community,” said Deputy Nguyen Anh Tri, who suggested reviewing all small and medium hydropower plants in the country to overcome the causes of flood discharge that cause bad consequences. If any hydropower plant cannot overcome the cause, it should be shut down. If flood discharge causes damage to people, it must be compensated appropriately; if it causes harm to people's lives, it must be criminally prosecuted,” said Deputy Nguyen Anh Tri.

Along with that, the delegate also proposed to review all small and medium hydropower projects that have been approved in all issued decisions to re-issue construction permits. In the delegate's opinion, instead of building small and medium hydropower plants, the State should build wind and solar power - renewable energy in which Vietnam has many advantages and has made many technological advances.

Meanwhile, Deputy Trinh Thi Tu Anh (Lam Dong) is interested in developing small modular nuclear power - SMR, saying that this type of energy has the advantage of flexible scale, small and medium capacity, shorter construction time and is especially suitable for gradually replacing old coal power sources or adding stable capacity to the national grid.

Citing the fact that SMR is no longer a pilot project, Deputy Trinh Thi Tu Anh emphasized that mobilizing state-owned enterprises to participate with private enterprises will help diversify resources, share risks and promote innovation.

“Encouraging businesses to research and invest in SMRs also means opening up opportunities to form a domestic module manufacturing industry, creating high-quality jobs, and raising Vietnam's position in the global nuclear value chain,” said the delegate. However, delegate Trinh Thi Tu Anh said that developing SMRs must be accompanied by conditions of safety, responsibility, and transparency.

Delegate Ha Sy Dong (Quang Tri) proposed to add criteria for risk assessment for slow-progressing power projects; at the same time, create a transparent mechanism for the provincial People's Committee to proactively propose adjustments to the list of key inter-regional power grid projects; propose to shorten the approval time for priority projects; add a mechanism to assign a focal point responsible for coordinating land - environment - fire prevention procedures; and complete the legal corridor for the BESS energy storage system (battery-based energy solution)...

Explaining and clarifying some contents, Minister of Industry and Trade Nguyen Hong Dien (representing the agency in charge of drafting the draft resolution) said that during the process of drafting the draft, the agency in charge had implemented it based on the practical experience of localities, enterprises, and all economic sectors with the highest goal of ensuring national energy security, meeting the requirements of double-digit growth in the coming period.

Receiving the opinions of the National Assembly deputies on the power planning, Minister Nguyen Hong Dien said that the draft resolution will be adjusted in the direction: regulations on adjusting and updating the planning will be adjusted to adjust the planning and develop the power according to practical requirements.

Regarding the authority to decide on investment policies for offshore wind power projects for the 2026-2030 period, Minister Nguyen Hong Dien said that the draft has been revised in the direction of: assigning the Prime Minister's authority to approve investment policies, and at the same time approving investors without auctioning or bidding for land use rights to select investors for offshore wind power projects.

“Small hydropower projects are not urgent projects, so we will mention the issue of small hydropower in the review and amendment of the Electricity Law, expected in 2026,” Minister Nguyen Hong Dien informed, adding that the development of offshore wind power is a new issue that many deputies are interested in. In fact, with a coastline of more than 3,000km, Vietnam has the potential to develop offshore wind power.

However, according to Mr. Nguyen Hong Dien, developing this type of energy is also linked to national security and many other issues. “The viewpoint of the Government in general and the drafting agency is very cautious, both exploiting the potential and taking steps to draw lessons…”, Mr. Nguyen Hong Dien said.
