The Ministry of Public Security is drafting a Circular stipulating the organization of legal knowledge tests on road traffic order and safety to restore points on driver's licenses . The test applies to individuals who already hold a driver's license but have had all points deducted according to Article 58 of the Law on Road Traffic Order and Safety.
According to the draft, the Traffic Police Department (Ministry of Public Security) or the Traffic Police Division of the Provincial/City Police will organize the examinations. The content will be issued by the Ministry of Transport . Participants will take a computer-based multiple-choice test to assess their knowledge of road traffic laws. Drivers of automobiles will also have an additional test simulating complex traffic situations to assess their ability to handle real-life scenarios.
The Ministry of Public Security proposes that those taking the driving test with an A1 license answer 25 multiple-choice questions in 19 minutes. Each question is worth 1 point, and a score of 21 points or higher is required. Those with A or B1 licenses will answer the same number of questions and in the same time, but must score 23 points or higher.
Those holding a Class B or C1 driver's license will take a 35-question multiple-choice test in 22 minutes. Each question is worth 1 point, and a score of 32 or higher is considered a "pass".
Those with D1 and C class driving licenses must answer 40 multiple-choice questions in 24 minutes and pass if they score 36 points or higher. For D2, D, BE, C1E, CE, D1E, D2E, and DE class driving licenses, participants must answer 45 multiple-choice questions in 26 minutes and pass if they score 41 points or higher.
However, a unique aspect of the driving license exams for these categories is that each exam paper includes one question where incorrect answers result in a failing grade. A failing grade means the candidate has not passed the exam.
For the simulation section, the Ministry of Public Security proposes that the time allotted for the 10 simulated traffic situations should not exceed 10 minutes. Each question has a maximum score of 5 and a minimum of 0 points, and its content describes various situations that pose potential traffic safety risks.
The score achieved by the test-taker corresponds to the time they recognize and identify potential traffic safety hazards through interaction with a computer equipped with simulation software. A score of 35 out of 50 points is considered passing.
Individuals holding a driver's license must pass both the theory and simulation tests. Failing the theory test disqualifies you from taking the simulation test. If you pass the theory test but fail the simulation, your theory test result will be valid for one year. You can retake the test within three days of failing the simulation.
Recently, in a document guiding the implementation of the Law on Road Traffic Safety, in addition to administrative fines, the Ministry of Public Security proposed 189 violations that would result in a deduction of 2 to 12 points from a driver's license. Of these, 28 violations would result in a 12-point deduction. These are all intentional, dangerous offenses with a high risk of causing traffic accidents.
Article 58 of the Law on Road Traffic Safety stipulates that a person whose driver's license has had all points deducted will not be allowed to operate a vehicle on public roads with that license. At least six months after the points are deducted, the driver's license holder is eligible to take an examination on knowledge of road traffic safety laws.
