Vietnam Social Security (BHXH Vietnam) responds: According to Clause 1, Article 65 of the 2024 Social Insurance Law, employees who have contributed to compulsory social insurance for 20 years or more, if their working capacity is reduced, are entitled to a pension at a lower age than the normal retirement age in certain cases:
Under 5 years of age and with a impairment of 61% to less than 81%; under 10 years of age and with an impairment of 81% or more.
Having worked for at least 15 years in a particularly strenuous, hazardous, or dangerous occupation as listed by the Ministry of Labor, War Invalids and Social Affairs , and experiencing a disability of 61% or more.
Documents required for claiming a disability pension include: social insurance book; document terminating the employment contract; and a medical assessment report on the degree of disability from the Medical Assessment Board (or a certificate of severe or exceptionally severe disability with a conclusion from the Medical Assessment Board).
Employers are responsible for referring employees for medical examination to determine the degree of disability.
According to Article 79 of the 2024 Social Insurance Law, within 20 days before the eligibility date for receiving a pension, the employer must submit the application to the social insurance agency. After receiving the complete application, the social insurance agency must process it within 20 working days; in case of refusal, a written response stating the reasons must be provided.
