The Ministry of Home Affairs has issued Decision 863/QD-BNV effective from July 1, 2025 on procedures for receiving specific sickness benefits as follows:

Procedure:
Step 1: Employees are responsible for submitting the required documents to their employer. The deadline for submitting these documents is no later than 45 days from the date of returning to work.
Step 2: Within 7 working days from the date of receiving complete documents from the employee, the employer is responsible for compiling a list of employees on sick leave and submitting it along with the relevant documents to the Social Insurance agency.
Step 3: Within 7 working days from the date of receiving all required documents from the employer, the Social Insurance agency is responsible for processing the application. If the application is not processed, a written response must be provided stating the reasons.
Methods of submission: In person, online, or via postal service.
Composition and number of documents
For employees or employees' children receiving inpatient treatment, the original or a copy of one of the following documents:
- Discharge papers;
- Summary of medical records;
- Other documents proving the inpatient treatment process;
- A list of employees on sick leave, compiled by the employer.
For employees or their children receiving outpatient treatment, one of the following documents is required:
- Certificate of leave of absence for social insurance benefits;
- The original or a copy of the discharge certificate indicating the period of outpatient treatment required after the inpatient treatment period;
- The original or a copy of the medical record summary indicating the period of outpatient treatment required after the inpatient treatment period;
- A list of employees on sick leave, compiled by the employer.
For workers or their children receiving medical examination and treatment abroad, the required medical documents must show the name of the illness and the duration of treatment, issued by the medical facility abroad, and must meet the following requirements:
- Have a Vietnamese translation notarized or certified in accordance with the law on notarization and certification;
- Legalized by consular authorities, except in cases where international treaties to which the Socialist Republic of Vietnam is a party provide otherwise.

Processing time: Within 7 working days from the date of receipt of complete documents as prescribed from the employer.
Subjects involved in the administrative procedure: Vietnamese citizens working in Vietnam, foreign workers working in Vietnam, and employers.
Administrative procedure implementing agency: Social Security agency according to the decentralization of Vietnam Social Security.
Results of administrative procedures: List of employees whose sick leave benefits have been processed.
Fees: None.
Name of the form/declaration form: As prescribed by the Vietnam Social Security, Ministry of Health .
Requirements and conditions for carrying out administrative procedures.
Employees are entitled to sick leave benefits when they take time off work in one of the following cases:
- Treatment for illnesses that are not occupational diseases;
- Treatment for injuries that are not work-related accidents;
- Treatment for accidents sustained while traveling from home to work or from work back to home, following reasonable routes and times as prescribed by law on occupational safety and health;
- Treatment and rehabilitation for work-related injuries or illnesses that recur due to work accidents, occupational diseases, or accidents as stipulated in point c of this clause;
- Donate, take, and transplant human tissues and organs according to the provisions of law;
- Taking care of sick children under 7 years old.
Employees are not entitled to sick leave benefits in the following cases:
- Self-injury, or self-harm;
- Using narcotic drugs or narcotic precursors as listed by the Government , except in cases of using precursor drugs or combination drugs containing precursors as prescribed by medical practitioners at medical facilities;
- During the initial period of time off work for treatment and rehabilitation following a work-related accident or occupational disease;
- During periods of leave as prescribed by law, or while on paid leave as prescribed by other specialized laws, or while on maternity leave or convalescence leave as prescribed by social insurance laws.
