Professor Pham Do Nhat Tien – former Assistant Minister of Education and Training – believes that the current model of state management of teachers leaves the problem of the teaching staff unresolved; he also proposes that it should be replaced with a human resource management model.

According to Dr. Pham Do Nhat Tien, alongside the outstanding results and advantages of teacher development, persistent shortcomings in the motivation, capacity, and structure of the teaching staff have persisted in recent years, particularly the shortage of teachers, including both overall shortages and localized surpluses or shortages.

“The problem of teachers, although recognized 20 years ago, still lacks a satisfactory solution. There are two fundamental reasons. Firstly, the regulations and policies regarding teachers have not adapted to the increasingly high demands placed on them, making the teaching profession less attractive. Secondly, state management of teachers has not been reformed to align with the new understanding of teachers and the teaching profession,” commented Dr. Pham Do Nhat Tien.

Regarding the teacher management model in Vietnam, Dr. Pham Do Nhat Tien stated that, in reality, within the unified state management of education, the Ministry of Education and Training only has authority in the unified management of professional aspects of education; the Ministry of Interior manages personnel matters in education; and the Ministry of Finance manages the financial aspects of education.

This means that although the Ministry of Education and Training has a responsibility to the State and society in implementing state management of education , it has no authority in decisions related to the two most important resources for implementation: money and human resources.

This division of responsibilities between the Ministry of Education and Training and the Ministry of Interior in the state management of teachers is characteristic of the personnel management model, consistent with the traditional state management model of education where the State plays the role of both the helmsman and the oar.

However, according to Mr. Tien, for more than 20 years, in the context of the formation and development of the education market, as the model of state management of education in our country has gradually shifted to a new public management model, teachers must be considered an important resource that needs to be regulated within a constructive legal framework, and the above-mentioned personnel management model is no longer suitable.

Professor Pham Do Nhat Tien argues that this management model is one of the main reasons why the problem of building a teaching staff that is sufficient in quantity and appropriate in scale has yet to be satisfactorily solved; he also proposes replacing it with a human resource management model.

“In this process, the Ministry of Interior, in coordination with the Ministry of Education and Training and the Ministry of Labor, Invalids and Social Affairs, will advise and submit to the competent authority the number and allocation of staffing quotas for the education sector, and supervise and evaluate the implementation. The Ministry of Education and Training and the Ministry of Labor, Invalids and Social Affairs are responsible for allocating staffing quotas to ministries, ministerial-level agencies, and provincial People's Committees, and directing the implementation within their assigned duties and powers,” proposed Dr. Pham Do Nhat Tien.

Based on his experience in local education management, Mr. Vu A Bang, Vice Chairman of the Dien Bien Provincial People's Committee, believes that the state management of teachers still has some limitations and shortcomings.

Currently, state management of teachers is governed by numerous laws (Civil Servant Law, Public Employee Law, Education Law, Vocational Education Law, Labor Law, etc.), leading to difficulties in research, implementation, and organization at the grassroots level. Some documents do not clearly define the concept, scope of regulation, or subjects of regulation.

Personnel management is overlapping between the Ministry of Interior and the Ministry of Education. The education sector is allocated the total number of personnel while the authority to recruit belongs to the Ministry of Interior. Personnel reduction is not linked to specific targets…

Based on the shortcomings and limitations identified, the Vice Chairman of the People's Committee of Dien Bien province proposed considering the decentralization of management of teachers and education management staff to ensure uniformity in recruitment, employment, and management of teachers from the central to local levels.

Specifically, the authority to manage teachers at the provincial level is delegated, the organization is restructured, and the number of state management personnel for district-level education departments is increased; if necessary, the authority to regulate teachers nationwide falls under the purview of the Ministry of Education and Training.

Minister of Education and Training Nguyen Kim Son presented and reported on the review of the draft Law on Teachers to the National Assembly.

Compared to current legal regulations, the draft Law on Teachers has several new points, including a proposal to grant the education sector more autonomy in recruiting and employing teachers.
