Proposed revisions to regulations on tutoring and supplementary classes: Increased transparency, reduced corruption.

Circular 29, which regulates extracurricular tutoring and is effective from February 14th, is currently being revised by the Ministry of Education and Training (MOET) to allow for greater flexibility in the duration of extracurricular tutoring within schools, by empowering the directors of provincial Departments of Education and Training to make decisions.

One of the notable new features is the increased flexibility in the duration of extra classes within schools. According to the current Circular 29, each subject is limited to a maximum of two extra classes per week, and only for three groups: students who have not met the requirements, high-achieving students, and final-year students registering for exam preparation. However, many localities believe this regulation is insufficient to meet actual needs.

According to the Ministry of Education and Training, during the implementation process and while incorporating feedback and suggestions from voters and society, the Ministry plans to revise the regulations. School principals will consider the necessity and appropriateness of adding extra teaching and learning time for certain student groups based on practical conditions, and propose it to the Director of the Department of Education and Training for consideration and decision.

The Ministry requires that these amendments and additions still adhere to the principles of Circular 29, which are: no fees charged, no increased academic pressure; enhanced quality of regular class hours; and time allocated for training through educational activities tailored to individual needs for holistic development.

Nguyen Huu Khuong, the principal of Minh Ha High School (Hanoi), expressed his agreement with the draft Circular 29, which allows schools to implement extra classes based on practical circumstances. Currently, two extra classes per week are insufficient, especially for 12th-grade students who need to intensify their studies and review in preparation for the upcoming high school graduation exam.

Mr. Nguyen Bao Quoc, Deputy Director of the Ho Chi Minh City Department of Education and Training, also agreed that the current number of 2 extra teaching hours per week per subject is insufficient to provide adequate tutoring for students and proposed that the Ministry of Education and Training review the regulations and increase it to 5 hours per week per subject.

Recently, there has been public outrage over teachers bringing students from outside the school into Ninh Thanh Secondary School (Hoa Lu Ward, Ninh Binh Province) for unauthorized tutoring. Investigations revealed that these teachers had contracts with licensed businesses operating under Circular 29, and had reported this to the school principal and the ward's People's Committee. However, the teachers later brought the students back to the school because the registered businesses needed to renovate their premises for their children's weddings, without notifying the principal.

From this, it can be seen that although extracurricular tutoring is regulated by Circular 29, in practice, shortcomings still arise that need to be reviewed and addressed promptly to ensure the rights of students. To overcome this, in the revised draft, the Ministry of Education and Training clearly stipulates the public disclosure of subjects, grade levels, time, teachers, fees, etc., on the electronic information portal or posted at the facility. This is considered a significant step forward, given that for many years, the situation of "underground" tutoring, unlicensed tutoring, and arbitrary fee collection has persisted and caused much frustration.

Furthermore, the principal's managerial responsibilities need to be strengthened. Specifically, teachers must report before starting and update any changes to previously communicated content. Principals are not blameless when teachers violate regulations on extracurricular tutoring, even if the incident occurs outside the school, as they are responsible for managing, supervising, and handling violations. If the principal fails to fulfill their responsibilities, not only will the teacher be disciplined, but the principal themselves may also face disciplinary action depending on the severity of the offense.

Local authorities have also introduced additional regulations regarding tutoring activities in their areas, aiming to promote transparency and accountability so that citizens can monitor these activities alongside the government and relevant agencies. Ho Chi Minh City has published a draft regulation on tutoring to solicit public opinion. The most notable point is the requirement to publicly disclose the list of students during inspections, a provision not included in the current Circular 29 of the Ministry of Education and Training.

According to Dr. Hoang Ngoc Vinh, former Director of the Department of Professional Education (Ministry of Education and Training), the draft regulations of Ho Chi Minh City, if implemented, would be one of the solutions to ensure transparency in tutoring activities. In addition, after nearly a year since its issuance, Circular 29 has revealed many shortcomings compared to reality, so adjustments are needed. Among these, transferring management responsibility from the district-level People's Committee to the commune level is consistent with the changes in the two-tiered government structure. Due to the narrower scope of management, supervision at the commune level will be more practical, timely, and effective.
