Prosecution of former Chairman of the Provincial People's Committee and former Director of the Department of Finance of Phu Yen province

On January 12, information from the People's Procuracy of Phu Yen province, this agency has just prosecuted the defendants Pham Dinh Cu (born in 1956, former Chairman of the People's Committee of Phu Yen province) and Do Duy Vinh (born in 1956, former Director of the Department of Finance of Phu Yen province) before the People's Court of the same level to try for the crime of Violating regulations on management and use of state assets causing loss and waste, according to the provisions of Clause 3, Article 219 of the Penal Code.

According to the indictment, in September 2007, the People's Committee of Phu Yen province decided to hand over 1,183 square meters of land at block A2, Hung Vuong street, Tuy Hoa city to Pymepharco Joint Stock Company without auction, with a land use term of 70 years. The land was handed over to Pymepharco Joint Stock Company to implement the Phu Yen Pharmaceutical, Cosmetic and Medical Services Business Center project.

After being granted the Land Use Rights Certificate, in June 2008, Pymepharco Joint Stock Company did not implement the above project as committed but mortgaged it to borrow capital from the bank.

In September 2010, Pymepharco Joint Stock Company contributed the above Land Use Right Certificate to Phu Yen Pharmaceutical Import-Export Joint Stock Company.

In November 2012, Mr. Do Duy Vinh - Director of the Department of Finance, signed an official dispatch requesting the Provincial People's Committee to allow Pymepharco Joint Stock Company to transfer the land use rights of block A2 to another bank.

This proposal was signed by Mr. Pham Dinh Cu to notify permission, with the content to build an office building, land use term of 50 years.

In July 2013, Pymepharco signed a contract to transfer the entire land to the Bank for Foreign Trade - Phu Yen Branch for 16 billion VND.

The indictment determined that Mr. Pham Dinh Cu and Mr. Do Duy Vinh knew that Pymepharco Joint Stock Company did not carry out the project, which was a case of land repossession.

However, the two men still carried out procedures for this enterprise to transfer the right to use the land area in violation of the law, causing a loss of more than 10 billion VND in state assets.
