Report on the results of drafting detailed regulations for the implementation of the Land Law, the Housing Law, and the Real Estate Business Law.

On the afternoon of October 15th, the Provincial People's Committee held a conference to report on the results of drafting detailed regulations for the implementation of the Land Law, the Housing Law, and the Real Estate Business Law under the provincial authority.

Comrade Pham Quang Ngoc, Deputy Secretary of the Provincial Party Committee and Chairman of the Provincial People's Committee, attended and chaired the meeting. Also present were Comrade Nguyen Cao Son, Provincial Party Committee member and Vice Chairman of the Provincial People's Committee; leaders of relevant departments and agencies; and heads of specialized divisions.

At the conference, delegates heard a report from the leaders of the Department of Natural Resources and Environment on the progress of drafting legal documents under the authority of the Provincial People's Council and the Provincial People's Committee detailing the implementation of some articles of the Land Law; and a report from the leaders of the Department of Construction on the progress of drafting documents under the provincial authority issued under the Housing Law and the Real Estate Business Law.

The delegates exchanged and discussed the difficulties and obstacles encountered in drafting regulatory documents; reported on the progress of implementation to date; and outlined the expected timeframe for issuing the documents. Concluding the conference, Chairman of the Provincial People's Committee Pham Quang Ngoc emphasized: When the Land Law, Housing Law, and Real Estate Business Law were promulgated, many decrees and circulars required the decentralization and delegation of authority to the Provincial People's Councils and People's Committees to decide on regulations within their jurisdiction. However, in the process of promulgating legal documents under the provincial authority, difficulties still arise in terms of legal basis, scientific basis, and practical foundation.

In recent times, following the Government's directive to focus on developing detailed regulations and guidelines for the implementation of the Land Law, the Housing Law, and the Real Estate Business Law, Ninh Binh province has been concentrating on researching, developing, and promulgating legal documents within its jurisdiction.

During the implementation process, the assigned departments and agencies proactively and actively advised on the drafting of documents, ensuring that practical requirements, procedures, and regulations for drafting legal documents were met, basically fulfilling the set deadlines and requirements. To date, several decisions within the authority of the Provincial People's Committee have been issued to promptly address practical issues. Regarding draft resolutions under the authority of the Provincial People's Council, the procedures have been largely completed for submission to the Provincial People's Council for approval at the special session in October 2024.

The remaining resolutions, based on legal regulations and guidelines from central ministries and agencies, will be basically finalized and submitted to the provincial People's Council's regular session at the end of 2024.

Legal documents falling under the authority of the Provincial People's Committee that have completed the appraisal process will be submitted for comments from members of the Provincial People's Committee for approval and promulgation before October 21, 2024. Documents that have met the remaining procedural requirements will be essentially completed in October 2024.

Based on the actual situation, legal regulations and guidance from higher-level specialized agencies will be implemented to ensure compliance with the law.

The Provincial People's Committee requests that all departments and agencies focus their efforts on completing the necessary documents and promptly submit them to the Provincial People's Committee and the Provincial People's Council for promulgation, in accordance with their authority, to meet the directives of the Government, the Prime Minister , and the provisions of the law, and to promptly address practical issues.
