Special mechanism for the Capital: Ensuring concentration, avoiding dispersion and in accordance with pilot principles

According to National Assembly delegates, prescribing specific mechanisms with too broad a scope could lead to a situation of "spreading specificities", making it difficult to monitor and allocate resources.

On the morning of December 8, continuing the 10th Session, the National Assembly discussed in the hall the draft Resolution on piloting a number of specific mechanisms and policies to implement large and important projects in the capital.

Discussing at the meeting hall, National Assembly delegates expressed their high consensus on the issuance of this Resolution, as this is an objective and timely requirement, aiming to remove difficulties that have existed for many years in the process of implementing major projects in the capital.

Clarifying the mechanism to protect people's legitimate rights and interests

Delegate Nguyen Thi Lan ( Hanoi City Delegation) highly appreciated the draft Resolution as a breakthrough but with strict control.

Accordingly, the draft Resolution has boldly decentralized and delegated power to the Capital City government, helping to shorten the process, enhance responsibility and initiative in implementation, but still within the framework of the Constitution, laws and supervision of the National Assembly and the Government .

“The resolution hits core bottlenecks such as planning, investment procedures, land acquisition, and urban reconstruction, thereby creating conditions for faster implementation of truly urgent projects with large spillover effects,” the delegate emphasized.

In addition, delegates said that the draft Resolution clearly demonstrates the spirit of putting people at the center, through compensation, support and resettlement mechanisms higher than general regulations; at the same time, emphasizing the requirements of publicity, transparency, anti-corruption and group interests in the implementation process.

For the Resolution to be effectively implemented, the female delegate of the Hanoi Delegation suggested that it is necessary to strengthen close coordination between the Central Government and Hanoi City, especially with projects that have inter-regional and inter-sectoral impacts.

During the implementation process, delegates recommended that it is necessary to pay attention to the legitimate rights of people and organizations, publicize information, communicate early and fully to people, create consensus and sharing right from the beginning.

"It is necessary to regularly monitor and evaluate the pilot process and promptly adjust any arising problems, in line with the spirit of a controlled pilot," the delegate noted.

Also concerned about protecting the legitimate rights of the people, delegate Duong Khac Mai (Lam Dong Delegation) commented that the provision of Clause 4, Article 10 of the draft Resolution allows the People's Committee to decide on coercive measures when the investor has achieved consensus from over 75% of home owners and land users corresponding to at least 75% of the area of ​​the urban renovation, embellishment and reconstruction area with the planning, compensation, support and resettlement plan, helping to resolve the bottlenecks of urban renovation, embellishment and reconstruction projects in the past time. However, the delegate said that this is a sensitive and complicated issue, directly affecting the legitimate rights and interests of the people; therefore, it is recommended to clarify the mechanism to protect the legitimate rights and interests of the people during the implementation process.

Supplementing strict criteria and conditions to avoid the situation of "spreading specificities"

Regarding the scope of projects to which special mechanisms are applied, the draft Resolution stipulates a wide range of projects, including public investment projects, PPP projects, projects of strategic investors, and urban renovation, beautification, and reconstruction projects.

According to delegate Ha Sy Dong (Quang Tri delegation), the regulation of the mechanism is too broad, which can lead to a situation of "spreading specificities", making it difficult to monitor and allocate resources. The review report also clearly stated the requirement to narrow the scope to ensure concentration, avoid spreading and be consistent with the pilot principle. The delegate suggested that it should only be applied to projects that are truly urgent, have a large spillover impact or are political tasks directed by competent authorities; the list must be public, updated and reported to the National Assembly periodically to ensure transparency, strict control and avoid abuse.

Concerning the regulations on selecting contractors and investors, delegate Hoang Van Cuong (Hanoi City Delegation) expressed his agreement with the regulations on selecting contractors or investors for projects implemented in the form of selection in special cases such as the Investment Law and the Bidding Law. However, the delegate said that it is necessary to consider the regulation that construction works can be started at the same time as the procedures for approving investment policies or deciding on investment policies because it is not advisable to let the approval of investment policies or deciding on investment policies be just a formality of legalization. Therefore, the delegate recommended that the approval of investment policies or deciding on investment policies for these projects should be implemented in a shortened form, so that it will not take too much time to start construction.

According to delegate Ha Sy Dong, the above regulation greatly expands authority, potentially posing risks of loss, negativity and legal responsibility. Citing the audit report which also warned of the risk of conflict with the bidding law, the delegate suggested adding stricter conditions: mandatory assessment of financial capacity and experience by independent consultants; public disclosure of all reasons for applying special mechanisms; and regulations on personal responsibility of the head if the appointment causes budget damage; "special, urgent" cases need clear criteria.
