Today, February 12, the National Assembly discussed the Draft Law on amending and supplementing a number of articles of the Law on Organization of the National Assembly and the Draft Law on Promulgation of Legal Documents (amended).

Delegates argued that one of the major changes in the draft law is the flexibility of the drafting process, shortening the time to expedite decision-making and "shifting roles" for the Government .

Accordingly, the National Assembly will decide whether or not to approve draft laws, while the detailed contents will be regulated by the Government. This may speed up the decision-making process but also lead to a passive attitude on the part of citizens and businesses.

According to the delegates, National Assembly deputies generally listen to public opinion more than ministries and departments; therefore, "shifting roles" to the Government means that the voice of public opinion through the press and social media will face some limitations.

Furthermore, one of the important issues of concern to the delegates is that many organizations currently post draft regulations on separate websites, making it difficult for citizens and businesses to track them.

According to the delegates, the publication process requires a common portal to post all versions of the draft, while also ensuring that related documents such as presentations and explanatory reports are publicly available for easy access by the public and businesses.

Another issue raised by delegate Ha Sy Dong during the discussion was the use of simplified procedures when issuing legal documents. In 2025, the Government plans to issue 130 documents, of which 69 will utilize simplified procedures. This procedure facilitates quick decision-making but limits the time for consultation. Even with simplified procedures, it is still necessary to ensure the transparency of information on the electronic portal so that mass media, the press, and the public can review the documents.

Participating in the discussion session, delegate Hoang Duc Thang, Deputy Head of the Standing Delegation in charge of the National Assembly Delegation of Quang Tri province, contributed his opinions on the Law amending and supplementing a number of articles of the Law on the Organization of the National Assembly and the Draft Law on the Promulgation of Legal Normative Documents (amended).

Specifically, Clause 1, Article 1 of the Amendments and Supplements to the Law on the Organization of the National Assembly (amending and supplementing Article 5) states that "The National Assembly shall enact laws to regulate the following contents: a, b, c ...l". However, delegates argued that detailing these contents would make it difficult to fully cover all the provisions and areas stipulated in the 2013 Constitution.

The delegate stated that, according to the 2013 Constitution, the National Assembly has the power to "exercise constitutional and legislative powers." The 2013 Constitution contains 10 provisions and areas that must be institutionalized by law through the National Assembly. Therefore, the delegate requested the drafting committee to list the powers to implement the provisions of the Constitution through law, or to list all 10 provisions and areas in the Constitution, and to consider omitting the provisions in Point 1, Clause 1 of the draft.

Regarding the provision in Clause 3, Article 1 of the draft amendment to Clause 1, Article 30 of the Law on the Organization of the National Assembly, the delegate suggested that the Drafting Committee consider and adjust it to allow National Assembly deputies to register to participate as members of the Ethnic Council or a committee of the National Assembly, based on their professional capacity, work requirements, and ability to participate in the activities of specialized agencies of the National Assembly.

In addition, delegates also expressed concern about the funding and facilities for the activities of the provincial National Assembly delegation and emphasized that the drafting committee should consider and research specific regulations in the law regarding the funding for the activities of the local National Assembly delegation from both central and local sources, so that localities have a basis for implementation.

Regarding the draft Law on the Promulgation of Legal Normative Documents (amended), delegate Hoang Duc Thang affirmed: Amending the Law on the Promulgation of Legal Normative Documents is an urgent requirement to meet practical demands and changes in the country's political, economic, and social systems. In the context of the Party and State striving to innovate and improve the law-making process, amending the law is not merely a technical legislative task but also a strategic step to enhance the effectiveness and efficiency of state management.

Delegates proposed adding the word "country" before the phrase "Socialist Republic of Vietnam" in the following articles: Clause 2, Article 5; Clause 1, Article 28; Clause 1, Article 29; Point d, Clause 4, Article 31; Point c, Clause 4, Article 34; Point d, Clause 4, Article 37; Point d, Clause 1, Article 50; Clause 1, Article 54; and Clause 5, Article 58.

The study further adds the principle of ensuring stability when drafting and promulgating laws in Article 5 of the draft, such as: "Ensuring stability, avoiding frequent amendments, unless there is a major change in policy or practice that creates an urgent need"; and adds the content that all Vietnamese citizens have the right to participate in giving opinions on policies and draft legal documents in Clause 3, Article 6 of the draft.
