The draft Law on Press (amended) has added a provision that organizations and individuals using press works must reach an agreement with the press agency to ensure copyright.

On the morning of December 4, continuing the 52nd Session, the National Assembly Standing Committee gave opinions on explaining, accepting, and revising the draft Press Law (amended).

Chairman of the Committee on Culture and Society Nguyen Dac Vinh presented a number of major issues in receiving, explaining and revising the draft law.

Some opinions suggest that there should be legally binding measures to require cross-border platforms (such as Google, Facebook, TikTok...) to pay copyright fees and share revenue with Vietnamese press agencies.

National Assembly deputies (NADs) proposed clarifying the responsibility of social networking platforms in preventing and handling toxic information, fake news, and false news on their platforms.

At the same time, there are opinions suggesting that the protection of press copyright in cyberspace needs to be regulated more specifically to avoid illegal copying, which is widespread on social networks, which is greatly affecting copyright and information transparency.

Accepting this opinion, the Standing Committee of the Culture and Social Affairs Committee said that to ensure copyright and related rights, the draft law has added Clause 2, Article 39, which stipulates: agencies, organizations and individuals using press works must reach an agreement with the press agency according to the provisions of law.

According to the review agency, information posted by cross-border platforms is "not within the scope of regulation" of the draft revised Press Law.

The processing of this information is regulated in Decree No. 147 of the Government on management, provision and use of Internet services and information on the network.

Accordingly, cross-border platforms must remove violating information within 24 hours of receiving a request from Vietnamese authorities.

Regarding the contents related to press economics , Mr. Vinh said that in response to the opinions of National Assembly deputies, the Standing Committee of the Committee and the drafting agency have reviewed and revised the regulations related to public investment, autonomy mechanism, and regulations on revenue from business activities of press agencies in the draft law.

Speaking at the meeting, National Assembly Chairman Tran Thanh Man acknowledged and highly appreciated the drafting agency and the verification agency for absorbing and editing many comments from the National Assembly Standing Committee and National Assembly deputies.

The National Assembly Chairman said that the opinions of the National Assembly deputies focused on policy mechanisms to develop the press , manage the press in cyberspace, protect the safety of press operations, licensing conditions and management of collaborators, and definitions and legal status.

The National Assembly Chairman expressed his high agreement on tax incentive policies for the press as stipulated in the Law on Corporate Income Tax.

Accordingly, all types of press enjoy a tax rate of 10%. Previously, printed newspapers enjoyed a tax rate of 10%, and other types of press were subject to a tax rate of 20%.

Regarding artificial intelligence, the National Assembly Chairman said that the draft law has added regulations that press agencies, authors, and works only use artificial intelligence to support press activities, and must comply with regulations on intellectual property and professional ethics. Press agencies are responsible for regulating the use of artificial intelligence in their agencies.
