The decree stipulates that the establishment of an industrial cluster must meet the following conditions:
a) Included in the list of industrial clusters at the provincial level that have been approved by the competent authority; has land suitable for the land use planning at the district level;
b) Enterprises, cooperatives, or organizations with legal status and the capacity to invest in and build technical infrastructure propose to be the investor in the construction of technical infrastructure for the industrial cluster;
c) In cases where industrial clusters have been established at the district level, the average occupancy rate of these clusters must exceed 50%, or the total unleased industrial land area of the clusters must not exceed 100 hectares.
Expanding an industrial cluster must meet the following conditions:
a) The total area of the industrial cluster after expansion shall not exceed 75 hectares; and the land available shall be in accordance with the land use plan at the district level;
b) Enterprises, cooperatives, or organizations with legal status and the capacity to invest in and build technical infrastructure propose to be the investor in the construction of technical infrastructure for the industrial cluster;
c) Achieving an occupancy rate of at least 60% or the demand for industrial land in the industrial cluster exceeds the available industrial land area of the industrial cluster;
d) Complete the construction and commissioning of essential shared technical infrastructure facilities (including internal roads, water supply, and wastewater collection and treatment) according to the approved detailed plan.
