Enterprises affected by natural disasters, epidemics, emergencies or force majeure events announced by competent authorities will not be considered as evading social insurance and unemployment insurance payments... This is a provision in the Decree on a number of articles of the Law on Social Insurance, effective from November 30.

In addition, some cases are not considered as insurance evasion when there is one of the following reasons, as announced by the competent authority. Specifically, storms, floods, natural disasters, epidemics, other force majeure situations that directly and seriously affect production, business activities and financial capacity; Emergency situations as prescribed by law that suddenly and unexpectedly affect the activities of agencies, organizations, and employers; Other force majeure events as prescribed by civil law.

In case of force majeure, the documents must be submitted before the 25th of the month with the written notice from the Social Insurance agency, to be considered for exemption from handling of violations.

The Social Insurance Agency is responsible for identifying acts of late payment or evasion of compulsory social insurance and unemployment insurance; applying or submitting to competent authorities for handling.

The Decree also stipulates the amount and number of days of late payment of compulsory social insurance and unemployment insurance. Accordingly, the amount of late payment of compulsory social insurance is the amount that the employer is responsible for paying according to the registration after the latest deadline for payment of compulsory social insurance.

The amount of late unemployment insurance payment is the amount that the employer is responsible for paying according to the registration after the latest unemployment insurance payment deadline prescribed by the law on unemployment insurance.

The number of days of late payment of compulsory social insurance and unemployment insurance is determined starting from the day after the deadline for registration to participate in social insurance and the latest deadline for social insurance payment, or after the latest deadline for unemployment insurance payment according to the provisions of the law on unemployment insurance.
