Lawyer Pham Van Chung (Department of Justice of Kon Tum province) advises on re-applying for nationality as follows:
Returning to Vietnamese nationality is the case where a person who used to have Vietnamese nationality but has renounced Vietnamese nationality or had Vietnamese nationality revoked and now wants to have Vietnamese nationality, must complete the procedure to re-register for Vietnamese nationality.
Therefore, the procedure for regaining Vietnamese nationality only applies to those who have been granted renunciation of nationality or have had their nationality revokedby the President of Vietnam.

In case you have not yet applied to renounce Vietnamese nationality or have not had your Vietnamese nationality revoked, and now want to regain Vietnamese nationality, you must carry out the procedure to register for dual nationality.
The procedure for registering dual citizenship varies depending on the regulations of each country. Since you are an overseas Vietnamese in the US, you should refer to the procedures prescribed by the US.
In case you have renounced your nationality or had your nationality revoked and now want to regain Vietnamese nationality, the application for re-registration of Vietnamese nationality is stipulated in Article 24 of the Law on Vietnamese Nationality, including the following documents:
1. Application for re-acquiring Vietnamese nationality (with prescribed form).
2. Copy of birth certificate, passport or other valid document;
3. Personal history;
4. Judicial record issued by a competent authority of Vietnam for the period the person applying for resumption of Vietnamese nationality resides in Vietnam; Judicial record issued by a competent authority of a foreign country for the period the person applying for resumption of Vietnamese nationality resides abroad.
The criminal record certificate must be issued no more than 90 days before the date of application submission;
5. Documents proving that the person applying to regain Vietnamese nationality used to have Vietnamese nationality;
6. Documents proving eligibility to regain Vietnamese nationality as prescribed in Clause 1, Article 23 of the Law on Vietnamese Nationality (having a wife, husband, biological father, biological mother or biological child who is a Vietnamese citizen; having special contributions to the cause of building and defending the Vietnamese Fatherland; being beneficial to the Socialist Republic of Vietnam; making investments in Vietnam; having renounced Vietnamese nationality to acquire foreign nationality, but not being allowed to acquire foreign nationality).
The processing time for applications to regain Vietnamese nationality is 85 days from the date the Department of Justice receives complete and valid applications.
