Application of information technology in the process of consultation and candidacy for the 16th National Assembly

On the morning of September 26, continuing the 49th session, the National Assembly Standing Committee gave opinions on the drafting of a joint resolution of the National Assembly Standing Committee, the Government and the Presidium of the Central Committee of the Vietnam Fatherland Front guiding the process of consultation and introduction of candidates for the 16th National Assembly and People's Councils at all levels for the 2026-2031 term.

According to the report, in recent times, the Constitution has been amended and supplemented in several articles by Resolution No. 203/2025/QH15, and laws on the organization of the State apparatus have been amended, supplemented, and newly enacted to implement the policy of streamlining the organizational structure in the political system and the two-level local government organization, including the provincial and commune levels. The Law on Election of National Assembly Deputies and People's Council Deputies has been amended and supplemented, adjusting the time frame for conducting consultations to nominate candidates for the National Assembly and People's Councils at all levels... These regulations have had an impact on the regulations regarding the time, roadmap, and responsibilities for organizing consultations in Joint Resolution No. 09/2021/NQLT/UBTVQH14-CP-ĐCTUBTWMTTQVN.

Furthermore, a review of the Fatherland Front's participation in and supervision of elections in 2021, along with feedback from provinces and cities, indicates that some detailed regulations and guidelines in Joint Resolution No. 09 are no longer relevant to current practices and need to be reviewed and amended to meet the requirements of the election of deputies to the 16th National Assembly and representatives to the People's Councils at all levels for the 2026-2031 term. The amendment of the Joint Resolution aims to ensure the uniformity and consistency of the legal framework on elections; to ensure detailed regulations and specific, convenient guidance in organizing consultations and nominating candidates for the 16th National Assembly and representatives to the People's Councils at all levels for the 2026-2031 term; and to ensure compatibility with the restructured and streamlined organizational model, contributing to the promotion of democracy and the improvement of the quality of National Assembly and People's Council representatives in the new term.

Presenting the verification report, the Chairman of the National Assembly's Committee on Delegate Affairs, Nguyen Thanh Hai, stated that the Committee agreed on the necessity of issuing the Resolution to create a complete and timely legal basis for organizing the election of deputies to the 16th National Assembly and deputies to People's Councils at all levels for the 2026-2031 term. The Resolution plays an important role in concretizing the provisions of the Law on Election of Deputies to the National Assembly and People's Councils (amended in 2025), ensuring a unified and synchronized election process, overcoming legal gaps and limitations from previous terms.

The National Assembly's Committee on Representative Affairs believes that the timelines in the consultation and nomination process for candidates stipulated in the draft resolution are consistent with the timelines already stipulated in Resolution No. 199/2025/QH15 of the National Assembly on shortening the term of the 15th National Assembly and People's Councils at all levels for the 2021-2026 term; the election date for the 16th National Assembly and People's Councils at all levels for the 2026-2031 term; and the consultation process steps stipulated in the Law on Elections, which has been amended and supplemented by Law No. 83/2025/QH15. The Committee on Representative Affairs agrees with the timelines for conducting the consultations and nominations of candidates for the National Assembly and People's Councils in the draft resolution.

Regarding cases where a candidate does not receive the confidence vote of more than 50% of the total number of voters in their place of residence, Clause 1 of Article 26 and Clause 1 of Article 28 of the draft Resolution stipulate: "Candidates who do not receive the confidence vote of more than 50% of the total number of voters attending the voter meeting in their place of residence shall not be included in the list of nominees at the third consultative meeting, except in special cases that require clear reporting for the consultative meeting to consider and decide." On this matter, the Committee on Representative Affairs recognizes that this regulation inherits from Joint Resolution No. 09; however, to ensure ease of application, it is necessary to clearly define the authority to consider the aforementioned special cases.

Accordingly, the Committee on Delegate Affairs proposed the following regulations: At the central level, the authority belongs to the Standing Committee of the Central Committee of the Vietnam Fatherland Front . At the local level, the authority belongs to the leadership of the Fatherland Front Committee at the same level as the agency directly organizing the consultative conference.

"Such regulations will ensure a unified legal basis and limit arbitrary application in special cases where the required 50% confidence vote is not achieved," the review report emphasized.

Regarding the application of information technology, the Committee on Delegate Affairs believes that, in the context of the strong national digital transformation taking place in all fields, and in accordance with Plan No. 56/KH/BCĐ dated July 4, 2025, of the Central Steering Committee on Information Technology Application and Digital Transformation, the Committee on Delegate Affairs proposes adding to the Resolution a provision on the application of information technology in some aspects of the candidate nomination process, specifically: "Encouraging and allowing the electronic submission of candidate dossiers and the sending of minutes of consultative meetings through secure online platforms as prescribed by the National Election Council," in order to enhance transparency, save time and resources, and ensure the ability to implement in cases of force majeure, especially in remote areas, islands, and communes with large geographical areas.

At the same time, to meet the progress requirements according to the timelines stated in the Draft Resolution, the Delegation Work Committee proposed to allow the organization of consultation conferences combining in-person and online forms for provinces with large areas and many communes, thereby ensuring efficiency, timeliness and synchronization in the entire consultation process between levels.

Also at the session, the Standing Committee of the National Assembly considered and adopted a Resolution of the Standing Committee of the National Assembly stipulating the organization of voter conferences; the nomination of candidates for People's Council representatives at the commune level in villages and residential areas; the consultation and nomination of candidates, and the compilation of lists of candidates for National Assembly representatives and People's Council representatives in by-elections (guiding Clause 5, Article 45, Clause 4, Article 52, and Clause 2, Article 92 of the Law on Election of National Assembly Representatives and People's Council Representatives).

The National Assembly Standing Committee considered the draft Joint Resolution amending and supplementing Joint Resolution No. 72/2025/NQLT/UBTVQH15-CP-DCTUBTWMTQVN dated February 20, 2025 of the National Assembly Standing Committee, the Government and the Presidium of the Central Committee of the Vietnam Fatherland Front detailing the contact with voters of National Assembly deputies and People's Council deputies at all levels.

The Standing Committee of the National Assembly considers and approves the Resolution promulgating the model working regulations of the People's Councils of provinces and cities; and the Resolution promulgating the model working regulations of the People's Councils at the commune, ward, and special administrative region levels.
