This morning, May 8th, Deputy Prime Minister Tran Hong Ha chaired an online meeting with ministries and localities to implement the Prime Minister's Directive on drafting decrees regulating compensation, support, and resettlement when the State recovers land, and decrees regulating land prices.

The amended Land Law was passed by the 15th National Assembly , 5th extraordinary session, on January 18, 2024 (Land Law No. 31/2024/QH15), which includes several provisions on "Compensation, support, and resettlement when the State recovers land".
On March 5, 2024, the Prime Minister issued Decision No. 222/QD-TTg promulgating the Plan for the implementation of the 2024 Land Law, assigning the Ministry of Natural Resources and Environment to lead the development of a decree regulating compensation, support, and resettlement when the State recovers land and a decree regulating land prices to provide detailed guidance on the implementation of some articles of the law.
The draft decree regulating compensation, support, and resettlement when the State recovers land consists of 3 chapters and 36 articles, detailing several articles and clauses of the Land Law regarding compensation, support, and resettlement when the State recovers land for national defense and security purposes, socio-economic development for national and public interests.
Compensation, support, and resettlement when implementing investment projects to renovate and rebuild apartment buildings are governed by the laws on housing.
The Decree on Land Prices provides detailed regulations and guidance for the implementation of the 2024 Land Law regarding land valuation methods; the construction, adjustment, amendment, and supplementation of land price tables; specific land valuation; and the conditions for practicing land valuation consulting.
During the conference, delegates focused their discussions on issues related to compensation, support, and resettlement plans; the arrangement of resettlement for those who voluntarily donate land use rights to the state for the implementation of transportation, irrigation, and technical infrastructure projects; and the target groups for support in stabilizing their lives, vocational training, and job placement.
Discussions included: the costs of ensuring compensation, support, and resettlement; how to calculate investor profits when applying the surplus method; selecting organizations to conduct land valuation; land valuation methods for transitional cases; the procedures and content for constructing land price tables, etc.
Speaking at the conference, Deputy Prime Minister Tran Hong Ha affirmed the importance of developing decrees regulating compensation, support, and resettlement when the state reclaims land, and decrees regulating land prices.
At the same time, we acknowledge and highly appreciate the opinions and suggestions from representatives of ministries, sectors, units, localities, and experts on the basic content of the draft decrees, ensuring consistency, uniformity, and consistency between land law and other relevant legal regulations, ensuring the inheritance, stability, and development of the land law system, and amending and supplementing regulations that are not in line with practice.
Upon adoption and promulgation, these decrees replace Decree No. 47/2014/ND-CP regulating compensation, support, and resettlement when the State recovers land, and Decree No. 06/2020/ND-CP amending and supplementing Article 17 of Decree No. 47/2014/ND-CP regulating compensation, support, and resettlement when the State recovers land.
