Only officials whose assets fluctuate by more than 1 billion VND are required to file supplementary declarations.

(Dan Tri Newspaper) - According to the new regulations, officials whose assets and income fluctuate by more than 1 billion VND during the year will be required to make supplementary declarations, instead of the current threshold of 300 million VND.

On the afternoon of December 10th, the National Assembly passed the Law amending and supplementing a number of articles of the Law on Prevention and Combat of Corruption with 442 out of 444 delegates voting in favor, with an important new point related to the value of assets and income that must be declared.

According to the law, assets and income that must be declared include: land use rights, houses, construction works and other assets attached to land, houses, and construction works; precious metals, precious stones, money, valuable papers and other assets where each type of asset has a value of 150 million VND or more; assets and accounts abroad; and total income between two declarations.

Compared to current law, the declared value has increased threefold, from 50 million VND to 150 million VND. This regulation applies to initial declarations, annual declarations, and declarations for personnel management purposes.

Along with increasing the declared value, the law also stipulates an increase in the value of additional assets and income that change during the year from 300 million to 1 billion VND. The supplementary declaration must be completed before December 31st of the year in which there are changes in assets and income.

The asset and income control agency monitors changes in assets and income of declarants through analysis and evaluation of information from declarations or other sources of information.

If a change in assets or income of 1 billion VND or more is detected during the year and the person obligated to declare fails to declare it, the asset and income control agency will request that person to provide or supplement relevant information; if the assets or income increase, an explanation of the source of the increased assets or income must be provided.

The amended law clearly states that declaring and explaining the origin of assets and increased income is one of the criteria for evaluating and ranking the performance of officials, civil servants, and public employees.

In his report on the feedback and explanations before the National Assembly's vote, the Inspector General of the Government, Doan Hong Phong, stated that the Government Inspectorate controls the assets and income of individuals obligated to declare their assets and income who hold positions from deputy director level and equivalent or higher, working in ministries, ministerial-level agencies, government agencies, and other agencies, units, and organizations established by the Government or the Prime Minister.

This agency also controls the assets and income of the heads and deputy heads of organizations established or whose operating regulations are approved by the Government or the Prime Minister .

The Chairman of the Board of Directors, Vice Chairman of the Board of Directors, Chairman of the Board of Members, Vice Chairman of the Board of Members, General Director, Deputy General Director, members of the Board of Directors, members of the Board of Members, Head of the Supervisory Board, Chief Accountant of state-owned enterprises… are also subject to asset and income control by the Government Inspectorate.

Ministries, ministerial-level agencies, and government agencies shall control the assets and income of persons required to declare their assets and income working in agencies, organizations, units, and state-owned enterprises under their management authority, except in cases falling under the authority of the Government Inspectorate and the Inspection Committee.

Provincial and city inspectors control the assets and income of individuals obligated to declare their assets and income who work in state agencies, organizations, units, and enterprises, and those representing state capital in enterprises under the management authority of the local government, except in cases falling under the authority of the Inspection Committee.

The government will regulate the agency responsible for controlling assets and income for individuals obligated to declare their assets and income who do not fall under the above categories.

The Law amending and supplementing a number of articles of the Law on Prevention and Combat of Corruption will take effect from July 1, 2026.
