Quang Ninh voters proposed 8 groups of issues after the 7th session of the 15th National Assembly

Immediately following the 7th Session of the 15th National Assembly, the Quang Ninh Provincial Delegation of National Assembly Deputies held a meeting with constituents to report on the session's results and the country's development situation in the first six months of 2024. Constituents in the province highly appreciated the responsible spirit of the Provincial Delegation of National Assembly Deputies in attentively listening to, absorbing, and proposing solutions and legitimate recommendations from constituents to the session; and actively contributing opinions to important draft laws. In particular, constituents highly appreciated the National Assembly's adoption of many important laws and policies that are practically relevant to people's lives.

During meetings with constituents following the 7th Session, voters in Quang Ninh province submitted eight groups of issues to the National Assembly representatives, specifically:

1. Proposal submitted to the Standing Committee of the National Assembly

(1) Currently, there are no specific regulations or guidelines on the activities of contacting voters by People's Council representatives at all levels, especially regulations and guidelines on the activities of contacting voters by People's Council representatives at the commune level; in reality, People's Councils at the commune level do not organize delegate groups, so the contacting of voters by People's Council representatives at the commune level faces many difficulties and is not consistent in implementation in different localities. We propose that the Standing Committee of the National Assembly consider and soon issue specific regulations and guidelines on the activities of contacting voters by People's Council representatives at all levels.

2. Recommendations submitted to the State Auditor General.

(2) The Van Don - Mong Cai expressway project under the public-private partnership (PPP) method, Build-Operate-Transfer (BOT) contract was approved by the Quang Ninh Provincial People's Committee in Decision No. 418/QD-UBND dated February 9, 2018 and approved for adjustment in Decision No. 4852/QD-UBND dated December 30, 2020. Accordingly, the expressway project invested under the public-private partnership method has its starting point at Km87+080 in Dong Ngu commune, Tien Yen district. The project has been completed and put into operation since September 1, 2022.

To provide a basis for finalizing the project's accounts, it is recommended that the State Audit Office pay attention to and direct the State Audit Office Region VI to organize and conduct an audit of the remaining project value from November 1, 2021 to August 31, 2022, to be carried out in the third quarter of 2024, in order to strengthen management and expedite the final settlement of the completed project, ensuring the efficient use of project investment capital.

3. Recommendations submitted to the Ministry of Culture, Sports and Tourism

(3) Government Decree 166/2018/ND-CP dated October 25, 2018, stipulates the authority, procedures, and processes for the preparation, appraisal, and approval of plans and projects for the preservation, restoration, and rehabilitation of historical and cultural relics and scenic spots (effective from December 15, 2019). The content includes the preparation, appraisal, and approval of overall site plans (detailed plans) of component projects according to the overall plan of the relics that have been approved by the competent authority, in accordance with the regulations on authority, procedures, and processes for the preparation and approval of detailed plans as stipulated in the Planning Law. However, some provisions of the current Decree are no longer suitable for the practical state management at the local level. It is recommended that the Ministry of Culture, Sports and Tourism pay attention to reviewing and evaluating, and promptly advise the Government to issue a Decree amending or replacing the above-mentioned Decree.

(4) The Ha Long Bay Heritage site has a buffer zone boundary (protection zone 2) covering both Ngoc Vung and Thang Loi communes of Van Don district, and according to regulations, construction projects in the above-mentioned communes (including public construction projects and residential construction projects of the people) must have the approval of the Ministry of Culture, Sports and Tourism before construction; this is inadequate. We propose that the Ministry of Culture, Sports and Tourism consider, review, and report to the competent authority to adjust the buffer zone boundary of the Ha Long Bay World Natural Heritage site in the direction of removing the two communes of Ngoc Vung and Thang Loi of Van Don district, Quang Ninh province from the buffer zone boundary of the heritage site.

4. Recommendations submitted to the Ministry of Interior

(5) On September 6, 2021, the Government issued Resolution No. 101/NQ-CP on resolving difficulties in implementing compulsory social insurance for Deputy Commanders of Military Units, Deputy Heads of Commune Police, and people working under labor contracts at Commune People's Committees. However, to date, there is no specific and detailed guidance document to implement the regulations according to the above-mentioned Resolution of the Government. It is recommended that the Ministry of Interior preside over, together with relevant ministries and sectors, to review and evaluate the situation and results of the implementation of Resolution No. 101 of the Government to provide guidance on organization, implementation, and ensuring the rights and policies for the relevant subjects.

(6) Clause 2, Article 8 of Government Decree No. 33/2023/ND-CP dated June 10, 2023, on commune-level officials and non-professional workers at the commune, village, and residential group levels, effective from August 10, 2023, stipulates that the Secretary of the Ho Chi Minh Communist Youth Union and the Chairman of the Vietnam Veterans Association at the commune level must have a university degree or higher; and have graduated from a secondary level of political theory or equivalent or higher. However, in practice, there are difficulties and challenges in implementing and applying the above standards. It is recommended that the Ministry of Interior preside over and coordinate with relevant ministries and agencies to review and report to the Government for consideration and amendment of the above standards, ensuring they are consistent with the practical situation at the grassroots level.

5. Recommendations submitted to the Ministry of Agriculture and Rural Development

(7) Based on Decision 318/QD-TTg dated March 8, 2022 of the Prime Minister promulgating the National Criteria Set for New Rural Communes and the National Criteria Set for Advanced New Rural Communes for the period 2021-2025. The content stipulates: The percentage of schools at all levels (kindergarten, primary school, secondary school, or multi-level general schools with the highest level being secondary school) meeting the physical infrastructure standards at level 1 and having at least 01 school meeting the physical infrastructure standards at level 2.

In 2018, the Ministry of Education and Training issued several regulations and guidelines on educational quality accreditation and the construction of national standard schools for preschools, primary schools, secondary schools, high schools, and multi-level general education schools. However, while these regulations are suitable for schools with a large number of classes and students, they are unsuitable for specialized schools in island communes with a small number of classes and students. They require large-scale construction projects with high investment costs, but the effectiveness and functionality are limited, leading to waste.

We propose that the Ministry of Agriculture and Rural Development, in collaboration with the Ministry of Education and Training, conduct research and evaluation of the implementation of Decision No. 318/QD-TTg dated March 8, 2022, of the Prime Minister and related regulations; and at the same time, research and propose appropriate solutions for areas with unique characteristics such as island communes.

6. Recommendations submitted to the Ministry of Defense

(8) The regimes, policies, and support levels stipulated in Government Decree No. 72/2020/ND-CP dated June 30, 2020, detailing some articles of the Law on Militia and Self-Defense Forces on the organization of force building and regimes and policies for militia and self-defense forces are stipulated in specific monetary amounts. However, according to the new basic salary policy, the basic salary has increased from 1,800,000 to 2,340,000 VND, but the regimes and policies under Decree No. 72 still apply specific monetary amounts established at the time of the old basic salary; the application will no longer be appropriate and outdated. It is recommended that the Ministry of National Defense research and report to the Government soon to amend and supplement the regulations in Government Decree No. 72/2020/ND-CP dated June 30, 2020, so that the current support levels must be consistent with the new basic salary policy; Simultaneously, the quality of policy-making should be improved, whereby regulations and policies should be developed using coefficients based on the base salary instead of specifying a fixed monetary amount.

(9) According to Resolution No. 837/NQ-UBTVQH14 dated December 17, 2019 of the Standing Committee of the 14th National Assembly on the arrangement of district and commune-level administrative units in Quang Ninh province. Accordingly, Tinh Huc commune was merged into Binh Lieu town (named Binh Lieu town). Before the merger, Tinh Huc commune was a commune in the land border area as stipulated in Decree No. 34/2014/ND-CP dated April 29, 2014 of the Government on the regulations of the land border area of ​​the Socialist Republic of Vietnam. Thus, currently in reality, Binh Lieu town is a commune-level administrative unit in the land border area. However, it has not yet been officially recognized by the competent state agency. It is recommended that the Ministry of National Defense review and report to the Government to consider regulating Binh Lieu town as a town in the land border area.

(10) Currently, many military personnel who enlisted after April 30, 1975, participated in border protection, and their living conditions are still difficult but they have not yet received health insurance benefits; at the same time, those who participated and were discharged after December 1988 have not yet received allowances like those who are subject to the provisions of Decision No. 62/2011/QD-TTg dated November 9, 2012, of the Prime Minister on regimes and policies for those who participated in the war to protect the Fatherland, performed international duties in Cambodia, and assisted Laos after April 30, 1975, and have been demobilized, discharged, or terminated. We propose that the Ministry of National Defence, in collaboration with relevant ministries and agencies, review the aforementioned list of beneficiaries and, at the same time, study and consider proposing to the competent authority regulations on health insurance for military personnel who enlisted after April 30, 1975, and participated in border defense; and expand the scope of beneficiaries entitled to the benefits and policies under Decision No. 62/2011/QD-TTg dated November 9, 2012, of the Prime Minister.

7. Recommendations submitted to the Ministry of Education and Training

(11) On March 9, 2010, the Prime Minister issued Decision No. 15/2010/QD-TTg regulating the allowance for teaching combined classes for teachers directly teaching primary school students in public educational institutions. Accordingly, Clause 2, Article 3 stipulates the allowance level: “a) Teachers teaching combined classes of two levels will receive an additional 50% of their monthly salary; b) Teachers teaching combined classes of three or more levels will receive an additional 75% of their monthly salary.” Implementing the 2018 General Education Program to ensure the teaching of subjects and educational activities requires that each class, including combined classes, has many teachers teaching different subjects. Therefore, the guidelines on teacher payment as stipulated in Decision No. 15/2010/QD-TTg dated March 9, 2010, of the Prime Minister are no longer relevant to the current situation. It is recommended that the Ministry of Education and Training, in collaboration with the Ministry of Interior and the Ministry of Finance, research and propose amendments or replacements to Decision No. 15/2010/QD-TTg dated March 9, 2010, of the Prime Minister.

8. Recommendations submitted to the Ministry of Health

(12) From July 1, 2024, the basic salary increased to 2.34 million VND/month. Therefore, the health insurance contribution rate for households also increased, while the lives of the majority of people in many places are still difficult. We recommend that the Ministry of Health research and evaluate to have solutions to support or propose to the competent authority to consider and decide on reducing or maintaining the health insurance contribution rate for household health insurance contributors.
