Provincial National Assembly delegates give comments on draft Law submitted to the National Assembly

Continuing the 10th session of the 15th National Assembly, on the morning of October 22, under the chairmanship of Vice Chairman of the National Assembly Nguyen Duc Hai, the National Assembly Delegation of Tuyen Quang province continued the group discussion on the Draft Law on Vietnam Civil Aviation (amended) and the Draft Law on Public Employees (amended).

Commenting on the Draft Law on Public Employees (amended), delegate Au Thi Mai suggested that the Drafting Committee should continue to study and perfect the implementation mechanism, especially regarding the responsibility of leaders in recruiting and using public employees; preferential policies and supervision mechanisms in recruiting public employees; and clearly distinguish between civil servants and public employees in the public service sector.

Regarding the autonomy mechanism, it is proposed that the draft Law should be amended in the direction of shifting from the mindset of autonomy based on revenue sources to the mindset of comprehensive autonomy linked to the tasks, results and quality of public services. Public service units have the right to decide on organization, human resources and finance within the scope of assigned tasks; superior agencies only carry out management, supervision and evaluation based on products and output efficiency.

Regarding civil servant recruitment, it is proposed that the draft Law should be more open and flexible in recruitment methods, not only through examinations but also by combining capacity assessment, interviews or selection based on actual capacity; adjusting the authority to recruit and appoint civil servants to ensure logic.

Regarding recruitment registration, it is recommended that the draft Law should stipulate open criteria to encourage talented people to participate in the public sector; supplement special recruitment mechanisms and preferential policies for disadvantaged areas, ethnic minority areas, especially recruitment for groups trained in medicine and pedagogy...

Regarding job positions, the Drafting Committee needs to clearly define the jobs or tasks associated with specific titles and positions, built on the functions and tasks of each public service unit. In cases where the unit is given autonomy, job positions and the number of employees need to be decided by the unit itself.

Delegate Trang A Duong proposed to add an assessment of the situation of ethnic minority civil servants and civil servants working in ethnic minority areas, mountainous areas, and areas with particularly difficult socio-economic conditions. The report still lacks data, analysis and recommendations for specific policies to attract, train, foster, as well as ensure adequate regimes and treatment for this group. Therefore, it is recommended that the drafting agency continue to research and supplement the assessment content and, on that basis, continue to research and perfect the relevant provisions of the draft Law, ensuring consistency with the Party and State's ethnic policies and guidelines, contributing to improving the quality of civil servants in ethnic minority areas.

Regarding the obligations of administrative officials, delegates suggested that when building and developing human resources, it is necessary to pay attention to implementing specific policies for officials who are ethnic minorities. In Clause 3, Article 12 of the draft Law: It is proposed to study and add the subject of officials who are ethnic minorities working in mountainous, border, island, ethnic minority areas, and areas with particularly difficult socio-economic conditions to enjoy higher priority.

Delegate Trang A Duong also proposed to study and supplement more clearly the preferential mechanism in recruiting civil servants who are ethnic minorities, especially in ethnic minority and mountainous areas, areas with difficult and especially difficult socio-economic conditions... At the same time, clarifying a number of contents and concepts, in the process of developing the draft Law on Civil Servants (amended), it is necessary to continue reviewing and ensuring consistency and synchronization in terms of policies (especially ethnic policies) with related laws, including the Law on Cadres and Civil Servants 2025; Law on Science, Technology and Innovation 2025; Law on Teachers 2025; especially laws on the field of education that are in the process of being amended and supplemented (such as the Law on Education, Law on Higher Education, Law on Vocational Training...) expected to be submitted to the National Assembly for consideration and approval at this 10th Session.

Delegate Nguyen Dac Vinh proposed to supplement and clarify regulations on liability exemption, regulations on labor contracts, job changes, regulations on complaints and evaluation of the results of quality assessment and classification of civil servants...

Also contributing ideas to the draft Law on Civil Servants 2010, delegate Nguyen Viet Ha gave his opinion on contents related to inspection and supervision; employment contracts; exemption from liability for civil servants; complaints; change of job position; disciplinary action against civil servants...

Commenting on the Draft Law on Civil Aviation of Vietnam, delegate Pham Thuy Chinh suggested studying the removal or transfer of Clause 6 (international cooperation in aviation) to Article 10 (Principles of international cooperation in aviation) to avoid duplication and ensure principles. This clause is consistent with international practices and enhances internationalization. At the same time, the delegate suggested that the drafting agency study and clarify some contents on aviation industry development, aviation database, airport classification, and supplement regulations on airport management assignment... to ensure conformity and compliance with regulations.
