Ho Chi Minh City needs a different and open institutional framework

On December 8, on the sidelines of the 10th Session of the 15th National Assembly, many delegates said that the Draft Resolution amending and supplementing Resolution 98/2023/QH15 on piloting a number of specific mechanisms and policies for the development of Ho Chi Minh City needs to create a stronger breakthrough for Ho Chi Minh City as a locality playing the role of economic locomotive of the whole country.

According to delegates, there is still much room to design a truly different, flexible and practical mechanism, aiming to open up a special institutional space to help Ho Chi Minh City promote its potential, be creative and make breakthroughs, contributing more to national growth.

Delegate Phan Duc Hieu ( Hung Yen Delegation): A stronger and more flexible mechanism is needed for the city to make a breakthrough.

In my opinion, there is still a lot of room and opportunity to build mechanisms that are truly close to the reality of Ho Chi Minh City, thereby creating a stronger driving force for the city's development. In fact, the specific mechanism for Ho Chi Minh City not only serves the city but also serves the common growth interests of the whole country. When Ho Chi Minh City develops, its contribution to national growth is very large. Therefore, when amending Resolution 98 this time, I think there needs to be some new and even stronger approaches in some contents.

Firstly, regarding the project portfolio to attract strategic investors, Ho Chi Minh City should not describe each project in too much detail. This can easily lead to rigidity, making it difficult to implement later. When investors survey the reality, their thinking and proposals may be different or change compared to the original description. Therefore, if the description is too specific, it will limit creativity and narrow the scope of solutions. I suggest reviewing and describing in a general direction, clearly stating the problem the city wants to solve. For example, parks, parking lots, services, waste treatment... instead of specifically describing "a 2,000 billion VND waste treatment plant". At that time, the city presents the problem, and investors propose the most optimal project.

Second, regarding the criteria for determining strategic investors, the current approach is still mechanical and does not properly reflect the market spirit and production and business activities. Setting rigid criteria on capital, implementation period, or project transfer restrictions, etc., in my opinion, is not appropriate. In a large project lasting 5-7 years, no one can predict anything; sometimes transferring is the best solution for the project to continue. The current rigid constraints will not be flexible.

International experience shows that instead of setting your own criteria, you can refer to prestigious business rankings: Top 500 Vietnamese enterprises, leading enterprises in Asia or the world, even ranked by industry. These enterprises have been screened over many years. In addition, you should approach according to practice: build a contract between the city and the investor, in which clearly commits the rights, obligations, progress and responsibilities of the parties... If the investor violates, they must compensate; conversely, if the government delays and causes damage, they must also compensate. This is a transparent mechanism, suitable for the market.

Third, this Resolution needs to thoroughly resolve the situation of many unfinished projects, especially previous BT projects. There are currently many problems related to land funds for payment for BT contracts. The biggest problem is that the State is slow to hand over land; but when handing over, the land price is calculated according to the time of handover according to the provisions of the Land Law. This causes investors to suffer a "double loss": they have been slow to receive land, have incurred large financial costs, and now have to calculate a new land price much higher than the time of completion of the project. Meanwhile, the investor has completed the project, handed it over and put it into use. This does not ensure the principle of fairness in payment obligations.

Therefore, I recommend that Ho Chi Minh City must propose a mechanism to resolve this issue in this Resolution. Land prices for payment for completed BT projects must be determined according to the time the investor hands over the project, not the time of land handover.
Regarding implementation after the Resolution is passed, the most important point is that the implementation must be really urgent and timely; the more delayed, the less impact the resolution will have.

The city should establish an interdisciplinary working group, not a consulting or directing group. This group includes experts and professional staff who actually work, and are given full authority to carry out tasks, monitor and handle them continuously over a long period of time. The Chairman of the City People's Committee can directly direct the group. This approach will replace the assignment to a single department or focal unit, which often leads to "blockages" or delays. I think this is a very necessary implementation step and Ho Chi Minh City should consider applying it as soon as the Resolution is issued.

Delegate Hoang Van Cuong (Hanoi city delegation): Need to create new creative spaces

We all know that Ho Chi Minh City was originally the largest economic center of the country, a dynamic and creative area, a place where new management institutions were created and then replicated throughout the country. After the merger of Binh Duong and Vung Tau, the position and potential of Ho Chi Minh City has grown stronger both domestically and internationally, which no other locality can compare to.

With such a large entity, Ho Chi Minh City does not wear the same institutional coat as other localities in the country, but needs to have a different and more open legal framework, creating a separate space for Ho Chi Minh City to freely create and develop under control. That is the goal and mission that this Resolution must achieve.

Therefore, I basically agree with all the mechanisms and policies on developing the public transport urban model (TOD), on urban planning and management; on attracting strategic investors, on the proposal to establish a free trade zone. I think all these proposals are still somewhat modest and not strong enough to really create a strong enough mechanism to help Ho Chi Minh City freely innovate and develop breakthroughs in line with its potential and current position.

Therefore, I propose that the Draft should be revised in some points such as: Review and remove all provisions that make it impossible to implement special mechanisms. The Draft Resolution is listing all the tasks that require special methods, listing and describing in detail the types of projects that need to be given incentives as strategic investors. If this Resolution approves the above tasks and the list of above types of projects, after a while another task appears or another strategic investment request appears, then the resolution must be revised to do it. Therefore, I propose that this resolution should not be listed like that, but should provide general principles and criteria on which to base the teaching of the People's Council of Ho Chi Minh City to decide on specific matters.

I propose to add one more content to this Resolution: In case there is a need for special regulations different from the current regulations, the People's Council shall issue a resolution and report to the Government so that the Government can submit it to the National Assembly Standing Committee for consideration, not deny it, and report to the National Assembly at the nearest session. The implementation of this mechanism will create a space for Ho Chi Minh City to innovate on new management mechanisms and become a laboratory for new institutions for the whole country.
