(Dan Tri) - Unmanned aircraft and other flying vehicles must be registered before being put into operation and use, according to the provisions of the Law on People's Air Defense.
This is the content stipulated in the Law on People's Air Defense recently passed by the National Assembly . In which, Article 29 of the Law stipulates the registration of unmanned aircraft and other flying vehicles, stating: "Unmanned aircraft and other flying vehicles must be registered before being put into operation and use".
When are drones exempt from licensing?
Registration conditions are meeting technical standards and regulations issued or recognized by the Ministry of National Defense ; having a technical standard certificate from the manufacturer for goods manufactured in Vietnam.
For imported drones and other flying vehicles, in addition to the above conditions, they must also have full valid documents when imported into Vietnam.
Regarding authority, the Law stipulates that the Public Security Agency registers unmanned aircraft and other flying vehicles of agencies, organizations and individuals according to regulations of the Minister of Public Security; the authority to register unmanned aircraft and other flying vehicles managed by the Ministry of National Defense is implemented according to regulations of the Minister of National Defense.

The Ministry of Public Security provides registration information for drones and other flying vehicles to the Ministry of National Defense for coordinated management.
In Article 30, the Law stipulates the content of flight licenses for unmanned aircraft and other flying vehicles.
"Flight licensing must be consistent with the technical specifications and intended use of drones and other flying vehicles, the ability to manage, operate, and monitor flight operations, and ensure national defense, security, order, social safety, aviation safety, and public interests," according to the provisions of the Law.
The Ministry of National Defense will grant flight permits or delegate them to units under its authority to grant flight permits; the Ministry of Public Security will grant flight permits or delegate them to units under its authority to grant flight permits for unmanned aircraft and other flying vehicles of the Ministry of Public Security and notify the Ministry of National Defense for coordinated management.
In case of granting flight permits in prohibited or restricted flight areas and other areas that affect the flight operations of military aircraft, the consent of the Ministry of National Defense is required.
Also according to the provisions of the Law, in case the Ministry of National Defense or the Ministry of Public Security grants a flight permit in the area of airports, airfields and other areas that affect the flight activities of civil aircraft, it must have the consent of the Ministry of Transport.
The Law on People's Air Defense also stipulates cases where unmanned aircraft are exempt from licensing, including:
- Operating outside of no-fly zones, restricted flight zones; operating range within visual range; with maximum take-off weight less than 0.25kg for entertainment purposes
- Operate in emergency situations to protect the lives and property of organizations and individuals according to the decision of competent authorities but must notify the aviation management agency before flying.
Flights not in accordance with the licensed content will be suspended.
The Law also clearly stipulates that organizations and individuals exploiting and using unmanned aircraft and other flying vehicles must be granted a flight license, except in cases where flight licenses are exempted.
Along with that, organizations and individuals using unmanned aircraft must forecast, notify, coordinate flights and obtain approval from state management agencies on the exploitation and use of unmanned aircraft and other flying vehicles.

The person directly controlling an unmanned aircraft or other flying vehicle must be 18 years of age or older, have full civil act capacity, and have an appropriate flight control license issued by a competent authority or a foreign license recognized by a competent authority issuing flight control licenses in Vietnam.
The Minister of National Defense and the Minister of Public Security shall prescribe conditions for operators of unmanned aircraft and other specialized flying vehicles serving national defense and security tasks.
If the drone flies outside the scope of its flight license; affects national defense, security and flight safety or the operator is not qualified to fly... the flight will be temporarily suspended.
The Minister of National Defense and the Chief of the General Staff of the Vietnam People's Army suspend flights of unmanned aircraft and other flying vehicles in the airspace and flight information regions managed by Vietnam, except for unmanned aircraft and other flying vehicles of the Ministry of Public Security that have notified the Ministry of National Defense.
The Minister of Public Security shall suspend flights of drones, other flying vehicles licensed by the Ministry of Public Security, or flying vehicles that violate targets protected by the Ministry of Public Security.
The Commander of the Air Defense - Air Force and the Commander of the Military Region shall suspend flights of unmanned aircraft and other flying vehicles within their management scope, except for unmanned aircraft and other flying vehicles of the Ministry of Public Security operating outside areas and targets managed by the military.
