(Chinhphu.vn) - The Ministry of Construction has issued Circular 10/2024/TT-BXD regulating quality management for construction materials and products.
Construction materials and products must meet quality standards as stipulated by current regulations.
According to the Circular , the groups of construction materials include: Cement and clinker; tiles; paving stones; sanitary ware; construction glass; lime; gypsum; refractory materials; construction stone; construction sand and gravel; building materials; roofing materials; concrete and concrete components; mortar; additives for cement, concrete and mortar; construction paint and finishing materials; ceiling panels, partitions; fibers, fiber sheets, fiber rods used in construction; water supply and drainage pipes; leveling and backfill materials; metal-based construction materials; wood and other plant-based construction materials; organic-based construction materials; construction materials from waste; intermediate products and goods to create construction materials; and other products and goods used to create construction works, excluding electrical equipment and technological equipment.
Construction materials that have the potential to cause safety hazards are those construction materials that, under reasonable and proper conditions of transportation, storage, preservation, and use, still have the potential to harm people, animals, plants, property, and the environment (Group 2 construction materials) under the management responsibility of the Ministry of Construction.
Construction materials that are not likely to cause safety hazards are those that, under reasonable and proper conditions of transportation, storage, preservation, and use, do not harm people, animals, plants, property, or the environment (Group 1 construction materials).
For construction materials exported or imported that are not listed and assigned HS codes (HS classification codes for export and import goods recorded in the Vietnamese Export and Import Goods List) or where there are differences or inconsistencies in classification and HS code assignment, the HS code assignment shall be carried out in accordance with the provisions of customs law.
After customs clearance, exporting and importing organizations and individuals send documents to the Ministry of Construction to serve as a basis for coordination with the Ministry of Finance to review, agree upon, update, and supplement the HS code list.
Labeling of construction materials in accordance with regulations.
The labeling of construction materials is carried out in accordance with the regulations in Government Decree No. 43/2017/ND-CP dated April 14, 2017 on product labeling; Government Decree No. 111/2021/ND-CP dated December 9, 2021 amending and supplementing a number of articles of Government Decree No. 43/2017/ND-CP dated April 14, 2017 on product labeling; and Circular No. 18/2022/TT-BKHCN of the Minister of Science and Technology detailing some mandatory contents to be displayed on product labels of certain product groups using electronic methods.
In cases where the content of product labeling for construction materials is specifically regulated in national technical standards, regulations, and legal documents, in addition to complying with the provisions of Clause 1, Article 4 of this Circular, construction materials must be fully labeled in accordance with the provisions of the corresponding national technical standards, regulations, and legal documents.
General requirements for quality management of building materials and products.
The Circular clearly states that construction materials and products must ensure quality in accordance with the provisions of Clause 1, Article 7 and Article 10, Chapter III of Government Decree No. 09/2021/ND-CP dated February 9, 2021, on the management of construction materials; publish applicable standards in accordance with the law on product and goods quality; and implement regulations on traceability according to Circular No. 02/2024/TT-BKHCN dated March 28, 2024, of the Minister of Science and Technology on the management of product and goods traceability.
For Group 1 construction materials: A quality management system must be applied to ensure product quality conforms to the corresponding technical standards and is labeled in accordance with the regulations in Article 4 of this Circular before the products are put into circulation on the market.
Voluntary declaration of conformity of products and goods to the corresponding standards. The declaration of conformity shall be carried out in accordance with the guidelines in Chapter II of Circular No. 28/2012/TT-BKHCN dated December 12, 2012, issued by the Minister of Science and Technology, regulating the declaration of conformity to standards, the declaration of compliance with technical regulations, and the methods of assessing conformity with standards and technical regulations; Circular No. 02/2017/TT-BKHCN dated March 31, 2017, issued by the Minister of Science and Technology, amending and supplementing some articles of Circular No. 28/2012/TT-BKHCN; and Article 11 of this Circular.
For Group 2 construction materials: A quality management system must be applied to ensure product quality conforms to the corresponding technical standards and labeling must comply with the regulations in Article 4 of this Circular before products are put into circulation on the market.
It is mandatory to declare that products and goods conform to the corresponding technical standards. The declaration of conformity is carried out according to the guidelines in Chapter II of Circular No. 28/2012/TT-BKHCN, Circular No. 02/2017/TT-BKHCN, and Article 12 of this Circular.
This Circular takes effect from December 16, 2024.
