Regulations on quality management of construction materials and products

(Chinhphu.vn) - The Ministry of Construction has issued Circular 10/2024/TT-BXD regulating quality management of construction material products and goods.

Construction materials and products must ensure quality according to current regulations.

According to the Circular , groups of construction materials (CM) products and goods include: Cement and clinker; tiles; paving stones; sanitary ceramics; construction glass; lime; gypsum; refractory materials; construction stones; construction sand and gravel; construction materials; roofing materials; concrete and concrete components; mortar; additives for cement, concrete and mortar; construction paint and finishing materials; ceiling panels, partitions; fibers, fiber boards, fiber bars used in construction works; water supply and drainage pipes; filling materials and embankment materials; metal-based construction materials; construction materials from wood and other plants; organic-based construction materials; construction materials from waste; intermediate products and goods to create construction materials; other types of products and goods used to create construction works, except for electrical equipment and technological equipment.

Construction material products and goods that are potentially unsafe are construction material products and goods that, under proper and proper transportation, storage, preservation, and use conditions, still have the potential to cause harm to people, animals, plants, property, and the environment (Group 2 construction material products and goods) under the management responsibility of the Ministry of Construction.

Construction material products and goods that are not likely to cause safety hazards are construction material products and goods that, under proper and proper transportation, storage, preservation, and use conditions, do not cause harm to people, animals, plants, property, or the environment (construction material products and goods group 1).

For exported and imported construction materials that have not been listed and have not been identified with an HS code (the classification code of imported and exported goods recorded in the List of Vietnamese imported and exported goods) or have differences or inconsistencies in the classification and identification of HS codes, the identification of HS codes shall be carried out in accordance with the provisions of the law on customs.

After customs clearance, exporting and importing organizations and individuals send documents to the Ministry of Construction as a basis for coordination with the Ministry of Finance to review, unify, update and supplement the HS code list.

Labeling of construction materials according to regulations

The labeling of construction materials is carried out in accordance with the provisions of Decree No. 43/2017/ND-CP dated April 14, 2017 of the Government on product labeling; Decree No. 111/2021/ND-CP dated December 9, 2021 of the Government on amending and supplementing a number of articles of Decree No. 43/2017/ND-CP dated April 14, 2017 of the Government on product labeling and Circular No. 18/2022/TT-BKHCN of the Minister of Science and Technology detailing a number of mandatory contents shown on product labels of a number of groups of goods by electronic means.

In case the content of labeling of construction materials is specifically regulated in national technical standards, regulations and legal documents, in addition to complying with the provisions in Clause 1, Article 4 of this Circular, construction materials must be fully labeled in accordance with the provisions in national technical standards, regulations and corresponding legal documents.

General requirements for quality management of construction materials products and goods

The Circular clearly states that construction material products and goods must ensure quality according to the provisions of Clause 1, Article 7 and Article 10, Chapter III of Decree No. 09/2021/ND-CP dated February 9, 2021 of the Government on management of construction materials; announce applicable standards according to the provisions of law on product and goods quality; implement regulations on traceability according to Circular No. 02/2024/TT-BKHCN dated March 28, 2024 of the Minister of Science and Technology regulating the management of traceability of products and goods.

For group 1 construction materials products and goods: Apply a quality management system to ensure product quality complies with relevant technical standards and labeling as prescribed in Article 4 of this Circular before putting the product into circulation on the market.

Voluntarily declare products and goods that comply with the corresponding standards. Declaration of conformity is implemented according to the instructions in Chapter II of Circular No. 28/2012/TT-BKHCN dated December 12, 2012 of the Minister of Science and Technology regulating the declaration of conformity, declaration of conformity and methods of assessing conformity with standards and technical regulations, Circular No. 02/2017/TT-BKHCN dated March 31, 2017 of the Minister of Science and Technology amending and supplementing a number of articles of Circular No. 28/2012/TT-BKHCN and Article 11 of this Circular.

For group 2 construction materials products and goods: Apply a quality management system to ensure product quality complies with relevant technical regulations and labeling as prescribed in Article 4 of this Circular before putting the product into circulation on the market.

It is mandatory to declare that products and goods comply with the corresponding technical regulations. The declaration of conformity is carried out according to the instructions in Chapter II of Circular No. 28/2012/TT-BKHCN, Circular No. 02/2017/TT-BKHCN and Article 12 of this Circular.

This Circular takes effect from December 16, 2024.
