A federal judge has ruled that the U.S. government must reinstate the contracts of thousands of employees recently laid off in an effort to streamline operations.
According to CNN, Judge William Alsup in California ruled on March 13th that six departments—the Department of Veterans Affairs, the Department of Energy, the Department of Agriculture, the Department of the Interior, the Department of Defense , and the Department of the Treasury—must immediately rehire trainees they had recently laid off. Judge Alsup stated that the order could be extended to other agencies later.
The headquarters of the U.S. Department of Veterans Affairs, one of the agencies ordered to rehire recently laid-off employees.
Mr. Alsup argued that the Office of Personnel Management (OPM) had illegally directed federal agencies to fire trainees, who often had less than a year of service.
The Department of Justice and the OPM had previously stated they were only issuing "guidance" to agencies, but Judge Alsup rejected this view, arguing that it was an order.
The White House called the ruling "absurd and unconstitutional." "A judge is attempting to usurp the power of hiring and firing from the executive branch in an unconstitutional manner. The president has the authority to exercise the powers of the entire executive branch; individual district judges cannot abuse the power of the entire judicial system to undermine the president's agenda," White House Press Secretary Karoline Leavitt said in a statement.
The Justice Department indicated on the same day that it would appeal to the appellate court.
This is just one of many lawsuits related to the Trump administration's job cuts program. A similar lawsuit is also pending in Maryland.
