On the afternoon of December 10th, under the chairmanship of National Assembly Chairman Tran Thanh Man and the direction of National Assembly Vice Chairman Nguyen Khac Dinh, the National Assembly voted to approve the Law amending and supplementing a number of articles of the Law on Prevention and Combat of Corruption with 442 out of 444 participating delegates voting in favor, accounting for 93.45% of the total number of National Assembly delegates.
The law clearly stipulates that the asset and income control agency monitors changes in the assets and income of those obligated to declare them through analysis and evaluation of information from the declarations or from other sources.
If a change in assets or income of 1 billion VND or more is detected during the year and the person obligated to declare it fails to do so, the asset and income control agency will request that person to provide or supplement relevant information; if the assets or income increase, an explanation of the source of the increased assets or income must be provided.
Simultaneously, the Law amends and supplements point a, clause 2, Article 31 of the current Law as follows: It requires those obligated to declare assets and income to provide and supplement relevant information and explanations when there are changes in assets and income during the year with a value of 1 billion VND or more, or to facilitate the verification of assets and income; it also adds a provision that declaring and explaining the origin of increased assets and income is one of the criteria for evaluating and classifying the level of task completion of officials, civil servants, and public employees.
Notably, the Law amending and supplementing Article 35 on assets and income subject to declaration of the current Law stipulates that assets and income subject to declaration include: land use rights, houses, construction works and other assets attached to land, houses, and construction works; precious metals, precious stones, money, valuable papers and other assets where each type of asset has a value of VND 150 million or more; assets and accounts abroad; and total income between two declarations.
The government shall specify in detail the assets and income that must be declared, the declaration form, and the procedures for declaring assets and income as stipulated in this article.
According to the Report on the Explanation, Acceptance, and Revision of the Draft Law amending and supplementing a number of articles of the Law on Prevention and Combat of Corruption, the Government has accepted and revised several other provisions such as: clearly defining the subjects required to declare assets in public service units from Deputy Head of Department and equivalent positions upwards (Clause 10, Article 1); amending and supplementing the regulations on annual declarations of officials under the management of Party committees and full-time Party members (Clause 12, Article 1); amending and supplementing the regulations on the responsibilities of the Supreme People's Court (Clause 21, Article 1).
Regarding other aspects of the draft Law, the Government has explained and clarified issues of concern to National Assembly deputies, such as: the scope of amendments and additions; the regulation that the agency responsible for controlling assets and income is the Party Committee's Inspection Committee at the level directly above the grassroots; the value of assets and income that must be declared and supplemented; the subjects required to declare assets and income annually; the public disclosure of asset and income declarations; and the reporting, denunciation, and handling of reports and denunciations regarding acts of corruption.
The Law amending and supplementing a number of articles of the Law on Prevention and Combat of Corruption will take effect from July 1, 2026.
Also at the session, with 437 out of 439 participating delegates voting in favor, representing 92.39% of the total number of National Assembly delegates, the National Assembly passed the amended Construction Law.
In addition, with 439 out of 444 delegates voting in favor, representing 92.81% of the total National Assembly delegates, the National Assembly also passed the Law amending and supplementing a number of articles of the Law on Citizen Reception, the Law on Complaints, and the Law on Denunciations.
