Requesting Gem Sky World investor to commit to progress and handle people's bad debt problem

Forced to commit to building social infrastructure, no business transactions allowed

Regarding the residential project with the commercial name Gem Sky World invested by Ha An Real Estate Investment and Trading Joint Stock Company (a member company of Dat Xanh Group). The project has a planned area of ​​over 92 hectares in Long Duc commune, Long Thanh district.

Recently, the People's Committee of Dong Nai province reviewed the report of the Department of Natural Resources and Environment (DONRE) of Dong Nai on the results of receiving citizens and inspecting the current status of land use and constructed works at the Gem Sky World project of Ha An Real Estate Investment and Trading Joint Stock Company.

The Provincial People's Committee has requested the Department of Natural Resources and Environment to review and consider handling the determination of conditions for transferring land use rights according to its authority, not to prolong the situation and not to create hot spots, causing loss of security and order in the locality.

In addition, Dong Nai province requires the investor to have a written commitment on the progress and time to complete procedures to complete the construction of 2 kindergartens, medical stations and legal procedures on fire prevention and fighting, and report to the Provincial People's Committee, Department of Natural Resources and Environment, and Department of Construction.

Previously, this project was involved in many controversies, customers continuously hung banners, complaining to the investor about the delay in handing over houses and land certificates as signed in the contracts.

Therefore, Dong Nai Provincial People's Committee requested Ha An Company to organize work, explain and persuade customers not to continue to complain about the 3 above-mentioned social infrastructure projects and have a written commitment not to conduct transactions with the remaining 1,727 land plots of the project in accordance with the provisions of law.

Need to handle customer bad debt problem

Regarding the above project, many people still complain that customers who buy houses and land have bad debts. Accordingly, many customers buy the project by borrowing from VP Bank through Dat Xanh Real Estate Services Joint Stock Company (DXS Company), a member company of Dat Xanh Group.

According to the commitment, customers who transact real estate products in the Gem Sky World project will receive support from DXS company for bank loan interest for 24 months. However, at present, DXS has not fulfilled its commitment to support interest rates as agreed. This has caused many customers to be transferred to bad debt.

There are many customers who have not yet reached the payment deadline with the bank, but the investor's delay in handing over the land use right certificate affects home buyers.

The Department of Natural Resources and Environment of Dong Nai province then chaired the meeting to invite investors, bank representatives, people and a number of relevant agencies to find solutions.

At the meeting, buyers of land and townhouses at the Gem Sky World project requested Ha An Company to make specific commitments on the time and progress of handing over the land and houses. In addition, DXS Company and the investor were requested to work with the bank to resolve issues related to loans, bad debts and loan repayment.

Speaking to Nguoi Dua Tin, a representative of Dat Xanh Group said that in October 2023, the investor will continue to meet with customers to resolve the problems. The investor explained that the issue of customers buying projects with bad debts has been sent to customers in writing to notify them of adjustments to policies to support loans to buy projects.

However, if there are customers who do not agree with the above plan, the company will have a dialogue with local authorities, banks and people before October 31.

This representative of Dat Xanh said that it has stopped business issues and focused on building infrastructure as committed to customers and local authorities.

Fined for fundraising

In early October 2023, the People's Committee of Dong Nai province issued a decision to impose administrative sanctions in the field of construction against Ha An Real Estate Investment and Trading Joint Stock Company.

Specifically, the People's Committee of Dong Nai province signed Decision No. 2276/QD-XPHC to impose an administrative fine of VND 900 million on Ha An Real Estate Investment and Trading Joint Stock Company, with Mr. Nguyen Chi Nghiem as General Director and legal representative.

The violation was determined to be illegal capital mobilization for the Gem Sky World Project.

In addition to the above fine, Ha An Company must, within 360 days from the date of receipt of the penalty decision, return the capital mobilized in violation of regulations.

At the same time, this company must also report in writing the implementation of remedial measures, every 90 days, for the Dong Nai Department of Construction to monitor and supervise.

If after 360 days Ha An Real Estate Investment and Trading Joint Stock Company has not returned the capital mobilized in violation of regulations, the province will apply coercive measures to remedy the consequences according to regulations.
