According to Mr. Nguyen Tuan Dung, Deputy Director of the Bac Ninh Department of Construction, the T01 and T02 buildings of the Que Vo HillView social housing project in Nam Son ward, Bac Ninh city, Bac Ninh province, invested by Song Hong Real Estate Management Co., Ltd., were granted Construction Permit No. 73/GPXD on May 17, 2024, by the Department of Construction.
However, currently on some social media platforms (Zalo, Facebook, etc.), there are widespread advertisements for the sale of apartments (T01 and T02 buildings) in the Que Vo HillView social housing project even though it does not yet meet the necessary conditions.
According to Mr. Nguyen Tuan Dung, Deputy Director of the Bac Ninh Department of Construction, this is a violation of the law because the project has not yet received official notification from the Department of Construction stating that it meets the conditions for sale or lease. The aforementioned buildings have not completed the necessary procedures and conditions for buying and selling housing as stipulated by regulations. Therefore, organizing sales, accepting deposits, and signing sales and lease contracts at buildings T01 and T02 of the project shows signs of violating the law on housing and real estate business.
To prevent the aforementioned violations, Mr. Nguyen Tuan Dung, Deputy Director of the Bac Ninh Department of Construction, stated that the Department has sent a letter requesting the Bac Ninh City People's Committee to direct relevant departments and the Nam Son Ward People's Committee to strengthen the dissemination of legal regulations on housing and real estate business. They are also requested to provide information on the legal status of the project, and to inspect and review the construction investment at blocks T01 and T02 of the Que Vo HillView social housing project, promptly preventing and handling any legal violations within the project.
Specifically for Song Hong Real Estate Management Co., Ltd., the Department of Construction has also issued a document requesting the company to seriously carry out the buying and selling of housing in accordance with the procedures for buying, selling, and leasing social housing as stipulated by law.
Actively coordinate with relevant agencies to review, prevent, and require organizations and individuals to immediately stop the buying and selling of social housing in violation of regulations. In cases where organizations or individuals are found to be deliberately violating or exploiting the policy for personal gain, report to the Department of Construction or the competent authority for handling according to the law.
A widely publicized press release was made through various media outlets, at the company's office, and on its website regarding the project's progress, specifically announcing that the social housing apartments in buildings T01 and T02 of the project do not yet meet the eligibility requirements for sale.
Song Hong Real Estate Management Co., Ltd., the investor of the project, also publicly posted on its Fanpage called “Que Vo HillView” clearly stating: “Recently, we have noticed many posts selling apartments in the Que Vo HillView T1 & T2 social housing project appearing on online social media. These posts contain many inaccurate details about our new Que Vo HillView T1 & T2 project. Please note that, as of now, our project has only received a construction permit from the Bac Ninh Department of Construction and is not yet ready for official sales or accepting deposits. To avoid falling victim to impersonation and fraud, please contact us directly for the most accurate information about the project status.”
The official announcement from Song Hong Real Estate Management Co., Ltd. - the project's investor - has contributed to preventing the illegal sale of social housing units by individuals seeking to "profit" from the policy, in collaboration with relevant authorities.
Regarding the conditions for buying and selling social housing, Mr. Nguyen Tuan Dung – Deputy Director of the Bac Ninh Department of Construction – affirmed: “Social housing units in blocks T01 and T02 are only permitted to be sold or leased when they meet the conditions for selling houses as stipulated in Clause 2, Article 63 of the 2014 Housing Law and must be officially notified by the Department of Construction that they meet the conditions for sale or lease.”
Specifically, the sale and lease-purchase of future social housing must comply with the following conditions: “There must be an investment project dossier for the construction of the housing, an approved technical design for the housing, and a construction permit if required; the foundation of the housing must be completed in accordance with the law on construction, and the investment in the construction of the road system, water supply and drainage, electricity for domestic use, and public lighting for the housing area to be sold or leased must be completed according to the detailed construction plan, design dossier, and approved project schedule; the mortgage must be released in cases where the investor has mortgaged the housing, except with the consent of the buyer, lease-purchaser, and the mortgagee; there must be a written notice from the provincial housing management agency stating that the housing is eligible for sale, except for social housing invested by the State using capital sources specified in Clause 1, Article 53 of this Law.”
