Urgently issue guidelines on decentralization, delegation of power, and delineation of authority when operating a two-tiered local government system.

Deputy Prime Minister Pham Thi Thanh Tra, Deputy Head of the Standing Committee of the Steering Committee for the implementation of the rearrangement and reorganization of administrative units at all levels and the construction of a two-tiered local government organizational model, has sent a document to Ministers and heads of ministerial-level agencies regarding focusing on resolving obstacles and difficulties in the operation of the two-tiered local government.

Regarding the 355 tasks requiring the issuance of documents to guide the implementation of decentralization, delegation of power, and delineation of authority in the operation of two-tiered local governments, the Steering Committee requests ministries and ministerial-level agencies to urgently issue legal normative documents within their authority or submit them to competent authorities for issuance, ensuring consistency among norms in the legal system, uniformity in understanding and applying the law, and ensuring that the tasks of decentralization and delegation of power are implemented smoothly, effectively, and feasible. The deadline for completion is no later than December 25, 2025.

Regarding the 10 tasks requiring adjustments to the authority between the central and local governments, or between different levels of local government, the Steering Committee requests the Ministries of Agriculture and Environment, Construction, and Science and Technology to develop proposals for adjusting authority, outlining the content of amendments and additions to current laws, decrees, and legal documents, and report to the Government's Steering Committee before December 15, 2025, for unified implementation.

Based on the Government's Decrees on decentralization and delegation of power, ministries and ministerial-level agencies shall review and plan to propose amendments and additions to legal provisions in specialized laws, ensuring compliance with the principles of decentralization, delegation of power, and delineation of authority as stipulated in the Law on Government Organization 2025, the Law on Organization of Local Governments 2025, and the requirements of Resolution No. 190/2025/QH15 of the National Assembly on handling some issues related to the reorganization of the state apparatus.

Regarding the resolution of difficulties and obstacles arising in the operation of the two-tiered local government system, the Deputy Head of the Steering Committee requested that ministries and ministerial-level agencies continue to coordinate with the Ministry of Justice and relevant agencies to urgently review the entire system of legal documents according to their respective sectors and fields of responsibility. This is to ensure the timely issuance of new regulations, amendments, and additions, guaranteeing the thorough resolution of overlapping, conflicting, and inconsistencies with the two-tiered local government model. Priority should be given to the following areas: finance and budget; land and planning; administrative reform and digital transformation; science and technology development; organizational structure, personnel, and policies; and education and training.

In addition, it is necessary to urgently study, resolve, and address the specific recommendations of agencies, units, and localities as outlined in Report No. 565-BC/BTCTW of the Central Organization Committee, completing this before December 15, 2025. For issues that cannot be resolved immediately, a plan for assignment, a specific timeline, and full information must be provided to the relevant agencies, units, and localities.
