The provincial inspectorate recommended not to accept the complaint of Mr. Nguyen But's household.

Mr. Nguyen But filed a complaint against 3 decisions of the Chairman of Phu Ninh District People's Committee, including: Decision No. 578 dated March 24, 2023 on canceling decisions related to land recovery for his household and the Compensation, support and site clearance plan to implement the project to expand the Office of the People's Council - People's Committee of Tam Vinh commune; Decision No. 2102 dated August 30, 2023 on land recovery and Decision No. 2218 dated September 8, 2023 on additional compensation and support for his household to clear the site for investment in construction of the above project.

Mr. Nguyen But said that the People's Committee of Phu Ninh district canceled the decision to reclaim his household's land in 2014 (reclaiming residential land), reissued the decision to reclaim land in 2023 (reclaiming fertile land) and did not arrange resettlement for his household, which did not comply with legal regulations.

Accordingly, the complaint requests the People's Committee of Phu Ninh district to allocate resettlement land to his household at the resettlement area of Huong Duong Kindergarten (old) in the form of exchanging recovered residential land for resettlement land as agreed by the People's Committee of Quang Nam province in Official Dispatch No. 3875 dated June 16, 2022; and Decisions No. 8235 and No. 8237 dated December 11, 2014 of the People's Committee of Phu Ninh district.

In the verification report (No. 68 dated April 19, 2024), according to the Provincial Inspectorate, Mr. Nguyen But was granted ^200m2 of land at plot number 12, map sheet 00 by the People's Committee of Tam Ky town (old) to build a house in Decision No. 536 dated July 21, 1990 and was confirmed to have built a house on this land area. However, in 1993, he moved after buying the house of Mr. Nguyen Dinh Luong at Team 1, Tam Vinh Cooperative.

After that, Mr. Nguyen But declared the land according to Decree No. 64/CP of the Government dated September 27, 1993 regulating the allocation of agricultural land to households and individuals for long-term stable use for agricultural production purposes for plot No. 12, map sheet 00 (corrected to plot No. 937, map sheet No. 28) as fertile land and registered the land purchased from Mr. Nguyen Dinh Luong at plot 1045a as residential land + garden. In 1998, Mr. Nguyen But was granted a Certificate of Land Use Rights by the People's Committee of Tam Ky town and had no complaints about the issuance of this certificate.

At the time of land acquisition in 2014, plot 937 on map sheet 28 was confirmed by the People's Committee of Tam Vinh Commune and the People's Committee of Binh Thanh Village to have no house on the land. This land area was used by Mr. But for planting acacia, banana and coconut trees, which is consistent with the land registration declaration according to the cadastral records implementing Decree No. 64/CP.

The Provincial Inspectorate believes that the land area that Mr. Nguyen But complained about, requesting land recovery and resettlement at plot No. 937, map sheet No. 28, has no basis for consideration and acceptance. The issuance of Decisions No. 578, No. 2102 and No. 2218 by the People's Committee of Phu Ninh district is in accordance with legal regulations. The discussion opinions of the relevant sectors are in agreement with the verification results of the Provincial Inspectorate.

Deputy Chief Inspector of the province Huynh Ngoc Tien said that the Provincial Inspectorate will recommend that the Chairman of the Provincial People's Committee resolve the complaint by not recognizing the content of Mr. Nguyen But's household's complaint.

Assign the Chairman of Phu Ninh District People's Committee to continue implementing Decision No. 93 dated January 16, 2024 of the Chairman of Phu Ninh District People's Committee on resolving the first complaint and decisions related to compensation and support for Mr. Nguyen But's household in accordance with the law.

At the same time, direct the Chairman of Phu Ninh District People's Committee to organize a review of the responsibilities of relevant collectives and individuals in land recovery, establishment, appraisal, approval and implementation of the Compensation, support and resettlement plan for Mr. Nguyen But's household that does not comply with legal regulations as stated in the report on the results of the complaint verification.
