On January 5th, news from the Office of the People's Committee of Thuan An City indicated that the unit had issued Decision 08/QD-XPHC, signed by Mr. Nguyen Thanh Son, Vice Chairman of the People's Committee of Thuan An City, imposing an administrative fine of 90 million VND on Ha An Real Estate Investment and Business Joint Stock Company (Ha An Company, a subsidiary of Dat Xanh Group) for the act of "Putting parts of a construction project, project items, or construction works into use without conducting acceptance testing as prescribed."
According to information from the authorities, the high-rise apartment and commercial service project on Nguyen Van Tiet Street (commercial name Opal Skyline) located on Nguyen Van Tiet Street, Lai Thieu Ward, Thuan An City, is invested by Ha An Company and built on an area of over 1 hectare, consisting of 2 blocks of 36 floors with 1,530 apartments.

Previously, the project was temporarily suspended from operation by the Fire Prevention and Rescue Police Department of Binh Duong province due to unsatisfactory acceptance testing results. The suspension period was from December 4th to January 3rd, 2024.
Currently, many apartments are occupied even though the project has not yet received fire safety certification and does not meet the requirements for residents to move in according to regulations.
In making the decision to handle the administrative violations, the local authorities also required the investor to rectify the consequences within 2 months and organize the acceptance of the parts of the construction project that have been put into use.
The People's Committee of Thuan An City also requested Ha An Company to strictly comply with the penalty decision. If Ha An Company does not voluntarily comply within the specified time limit, enforcement will be carried out in accordance with the law.
Regarding the issue of residents moving into the project despite not yet meeting the necessary conditions, a representative from Dat Xanh Group stated that they were facilitating interior renovations for the residents. The representative also informed that the developer is coordinating with the contractor and relevant authorities to address these issues.
According to the People's Committee of Thuan An City, there is another apartment building in the area, the Eden Thuan An high-rise residential project, that does not meet fire safety and rescue standards and is currently suspended from operation by a decision of the Fire Prevention and Rescue Police Department of Binh Duong Province Police from July 21, 2023.
Scandal of wrongdoing
Ha An Real Estate Investment and Business Joint Stock Company (a subsidiary of Dat Xanh Group) is also one of the names singled out by authorities in Dong Nai province for numerous violations in the process of developing its projects.
As reported by Nguoi Dua Tin , Ha An Company is the investor of the Gem Sky World project in Long Thanh district, Dong Nai province. This project has been plagued by numerous controversies, with customers continuously displaying banners and complaining to the investor about delays in handing over houses and land titles as stipulated in the contracts.
Authorities have required the investor to provide a written commitment outlining the progress and completion timeline for the construction of the two kindergartens, the health station, and all necessary legal procedures related to fire safety.
Furthermore, in early October 2023, the People's Committee of Dong Nai province signed Decision No. 2276/QD-XPHC imposing an administrative fine of 900 million VND on Ha An Company. The violation was identified as improperly raising capital for the Gem Sky World Project.
