On March 20, the leader of Lam Dong Department of Construction said that Mr. Vo Ngoc Hiep, Vice Chairman of the Provincial People's Committee, had just issued Document No. 2113/UBND-XD directing the Department of Construction to receive documents, consider granting construction permits, and adjust the construction permit for the golf club building in Cu Da Lat Hill according to authority and legal regulations.

Accordingly, in the process of considering granting construction permits and adjusting construction permits, it is necessary to ensure the correct location, scale, architectural planning indicators, zoning plans and detailed plans approved by competent authorities. Before granting construction permits or adjusting construction permits according to regulations, it is necessary to coordinate with the Department of Culture, Sports and Tourism to check whether the project construction location is in the protection area 2 of Xuan Huong Lake scenic spot.
In addition, Lam Dong province assigned the Department of Natural Resources and Environment, the Department of Construction, and the People's Committee of Da Lat City, according to their assigned functions, tasks, and powers, to guide Hoang Gia DL Joint Stock Company in carrying out procedures related to land, planning, construction licensing, and other related procedures in accordance with the law.
Service block 2 was built without a license.
Regarding the construction of the golf club building in Cu Da Lat Hill, in a previous press conference, Mr. Le Quang Trung, Director of Lam Dong Department of Construction, said that the building consists of 2 construction items: service block 1, service block 2 and reception house.
In which, service block 1 was granted license No. 02/GPXD on January 12, 2023 by the Department of Construction to build part of the basement of block 1, but during the construction process, the investor committed 2 violations including: constructing a construction item with a part of the area (130 m2 ) on land that has not been permitted by the competent authority to change the land use purpose (from protective forest land to construction).
Second, the construction is not in accordance with the granted license. Specifically, according to the license, the basement (licensed area 2,639 m2 ) but the actual construction is 2,900 m2 ; the unlicensed area includes the ground floor illegally built 1,933 m2 , the upper floor is 1,100 m2 . The total floor area in violation is 3,294 m2 . This act violated the provisions of Decree 16/2022/ND-CP dated January 28, 2022 of the Government .
Also according to the representative of Lam Dong Department of Construction, the service block 2 and reception block are 2 construction items that have not been granted a construction permit. During the construction process, the investor committed 2 violations: constructing construction items on a part of the land area that has not been permitted by the competent authority to change the land use purpose with an area of 4,499.9 m2 (service block 2 is 2,627.5 m2 and reception block is 1,872.4 m2 ). Constructing construction items without a construction permit on a part of the land area that has been changed the land use purpose.
For the above violations, the People's Committee of Da Lat City issued 2 decisions to fine Hoang Gia DL Joint Stock Company a total of 240 million VND. At the same time, the investor was required to stop construction, contact the authorities, and prepare documents to apply for a construction permit according to regulations.
Construction unit dismantles ancillary works to serve the construction of the golf club building
For the act of constructing construction items on land areas that have not been permitted by competent authorities to change the land use purpose, the Chief Inspector of Lam Dong Department of Natural Resources and Environment imposed an administrative fine of 45 million VND; at the same time, forced to return the illegal profits obtained from committing the administrative violation of 527 million VND.
This company has complied with the fine and returned the illegal profits according to the above penalty decision. The remedial measure is to force the investor to register the land to change the land use purpose according to Document No. 5667/UBND-QH dated August 11, 2021 of Lam Dong Provincial People's Committee.
Up to now, the investor has not yet dismantled the illegal construction.
As Thanh Nien reported, regarding the illegal construction of Hoang Gia DL Joint Stock Company, on January 11, 2024, Lam Dong Provincial People's Committee issued a document directing the urgent handling of construction violations at the Golf Club building project of this company. In particular, Da Lat City People's Committee was assigned to request the investor to voluntarily dismantle the violating construction items before January 25, 2024. After the deadline, if the investor does not comply, the organization will organize forced demolition according to regulations before February 15, 2024.
In fact, up to now, the investor has not yet carried out the demolition but is waiting for the petition to be resolved and for a construction permit and adjustment of the construction permit for the unlicensed and illegal construction items in Cu Da Lat Hill.
