During questioning at the 8th Session of the 15th National Assembly, Representative Trang A Duong (from Ha Giang province) reflected on the reality that many private companies, investors, and multi-specialty clinics are challenging state management agencies in the field of healthcare. Specifically, after being penalized for administrative violations and temporarily suspended from operation for 3-4 months, these entities declare dissolution and then establish new companies and open different clinics. Meanwhile, the management and medical staff are entirely the same people from before, even operating at the same location under a completely new name.
Representatives from Ha Giang province requested that the Minister of Health propose solutions to definitively address the aforementioned situation.

Minister of Health Dao Hong Lan stated that, according to the Law on Medical Examination and Treatment, each facility is granted only one operating license. This serves as the basis for private clinics to practice and must meet conditions regarding facilities, medical equipment, and personnel. Regarding personnel, the unit is required to have a certain number of full-time employees, and practitioners must register and meet conditions such as not practicing at two facilities simultaneously.
If a healthcare professional works full-time at a healthcare facility, and that facility is suspended, they cannot immediately work for another facility; instead, they must terminate their employment contract with the facility that just violated the regulations.
Experience over the years has shown that some private clinics are suspended due to the fault of the person responsible for professional matters at that facility. Therefore, depending on the severity of the violation, the person primarily responsible for professional matters may have their license revoked and may not be able to operate immediately. Clinics wishing to resume operations must comply with regulations and meet new requirements to be granted a license.
Minister Dao Hong Lan affirmed that, based on the feedback from delegates, the Ministry of Health acknowledges and will take note of the regulations of the Law on Medical Examination and Treatment during the implementation process, especially regarding violations, to avoid abuse and exploitation.
