Several new points are expected in the regulations for secondary schools.

GD&TĐ - The draft regulations for primary schools, junior high schools, high schools, and multi-level general education schools have been published by the Ministry of Education and Training for public consultation.

In line with the two-tiered local government model

Currently, general education schools are operating according to Circular No. 28/2020/TT-BGD&ĐT dated September 4, 2020, issued by the Minister of Education and Training, promulgating the Charter of Primary Schools; Circular No. 32/2020/TT-BGD&ĐT dated September 15, 2020, issued by the Minister of Education and Training, promulgating the Charter of Junior High Schools, High Schools, and multi-level general education schools; Decision No. 51/2002/QĐ-BGD&ĐT dated December 25, 2002, issued by the Minister of Education and Training, on transferring and admitting students to junior high and high schools; and Circular 50/2021/TT-BGD&ĐT amending and supplementing some articles of the Regulations on transferring and admitting students to junior high and high schools issued together with Decision 51/2002/QĐ-BGD&ĐT dated December 25, 2002. Circular 31/2023/TT-BGD&ĐT dated December 29, 2023, promulgates the regulations on junior high school graduation examination.

These documents have concretized the provisions of the 2019 Education Law and created a legal basis to contribute to the effective management and administration of schools.

However, in reality, the current system of legal documents regulating the activities of general schools is fragmented and cumbersome. With the transition to a two-tiered local government model and the policy of streamlining the administrative apparatus and procedures, and promoting digital transformation, some content in these documents is no longer appropriate.

This requires unifying them into a new legal document that is consistent with the laws and legal documents already enacted.

Notable new features

The draft Circular promulgating the Regulations for primary schools, junior high schools, high schools, and multi-level general education schools consists of 8 Chapters and 47 Articles, with the following notable additions and adjustments:

Add boarding schools and other specialized schools to the regulations on types of schools and the general education school system; and specialized education organizations.

The responsibilities for managing education will be shifted from the District People's Committee and the Department of Education and Training to the Commune People's Committee and the Department of Culture and Social Affairs. This change aligns with the policy of "focusing on perfecting legal regulations to promptly address bottlenecks, obstacles, mechanisms, and policies" and "promoting decentralization and delegation of power" as outlined in Resolution No. 71-NQ/TW dated August 22, 2025, of the Politburo on breakthroughs in education and training development.

The regulations clearly define the powers and responsibilities of school administrators, teachers, and staff. Simultaneously, they remove the requirement to issue junior high school diplomas to fulfill compulsory education obligations at the junior high school level; the requirement to select textbooks; and the requirement for a school board in public schools.

These regulations, or omissions, are intended to ensure consistency with the provisions of the Law amending and supplementing certain articles of the Law on Education and the Law on Teachers.

Minimize administrative procedures related to school transfers and student admissions.

The draft Circular specifies the management of digitized school records. Electronic records will be used to replace paper records according to a roadmap that suits the conditions of the locality, the school, the teachers' capabilities, and ensures the legality of electronic records. The management of electronic records will be regulated by the Department of Education and Training according to the connection and data standards of the Ministry of Education and Training.

At the same time, to minimize administrative procedures for parents and students, the draft regulations stipulate that school transfers and student admissions will be carried out through the Public Service Portal.

In cases where it is not possible to submit the application and declare information for school transfer, enrollment, or re-enrollment through the Public Service Portal, students or their parents/guardians must submit the application for school transfer, enrollment, or re-enrollment to the receiving school in person, online, or by mail.

Building a safe, healthy, and humane educational environment.

The draft Circular stipulates the duties, powers, professional standards, and requirements for continuous professional development of teachers. These regulations contribute to improving the quality of the teaching staff, increasing professionalism, responsibility, and transparency in the performance of professional duties. At the same time, they ensure full legal rights, helping teachers and staff feel secure in their work; improving the quality of education; and strengthening public trust in the teaching staff.

The draft also includes regulations on conduct, prevention of school violence, and prevention of violations of professional ethics in schools, aiming to build a safe, healthy, and humane educational environment.

Furthermore, the draft Circular also specifies standards for facilities, teaching equipment, libraries, and quality assurance conditions to create motivation for investment and modernization of schools; ensure safety, reduce waste, and improve the efficiency of using public assets.

The coordination mechanism between family, school, and society is clearly defined, creating conditions for parents, social organizations, and the community to participate in the educational process; strengthening social supervision, mobilizing resources for educational activities, preventing risks, and supporting students' holistic development.
