Clarifying the criteria for "important, urgent" projects

Discussing at the Hall on the mechanism and policy for national energy development in the period of 2026 - 2030, on the afternoon of December 8, delegate Huynh Thi Phuc (Ho Chi Minh City) said that the concept of "important and urgent national project" is still qualitative, if the criteria are not specified, the application in practice can lead to inconsistent understanding, posing potential legal risks for both investors and implementing agencies.

From this analysis, delegate Huynh Thi Phuc proposed to add a regulation assigning the Government to determine specific criteria for this type of project, linked to capacity scale, level of impact on the energy system and requirements to ensure energy security in each period. Clear regulations will help increase transparency, limit different interpretations, and create legal security for projects.

The delegate also pointed out that there are currently many lists of energy projects issued at different levels, such as: List in the National Energy Master Plan (Decision 893/QD-TTg); List of important national works and projects, key projects of the energy sector in Decision 2634/QD-TTg; New concept of important and urgent projects in the draft Resolution itself.

According to delegates, although each category has different goals, if there is a lack of connection and inheritance mechanism, it will lead to overlap, causing difficulties in determining which projects enjoy priority mechanisms, thereby affecting implementation progress.

On that basis, the delegate proposed to clearly stipulate: projects in the priority list in the Planning under Decision 893 are naturally subject to the Resolution's mechanism, independent of the list in Decision 2634. At the same time, it is necessary to add the content "List of important projects, priority investment in national sectoral Planning" to Articles 3, 17, 18 and 24 to ensure inheritance and synchronization. The delegate emphasized the requirement to decentralize the authority to determine and adjust the list to increase initiative, avoiding the situation where projects are behind schedule due to over-reliance on adjustment procedures.

Delegates also recommended the need to form a unified legal framework, reduce internal procedures, increase accountability and post-audit, and at the same time create favorable conditions for key projects to be implemented in a flexible and timely manner to ensure the Resolution comes into life, contributing to ensuring energy security in accordance with the spirit of Resolution 70 of the Politburo on ensuring national energy security until 2030, with a vision to 2045.
