Clarify the criteria for projects that are considered "important and urgent".

During the National Energy Development Mechanism and Policy Discussion in the Assembly Hall on the afternoon of December 8th, on the mechanism and policies for national energy development in the period 2026-2030, delegate Huynh Thi Phuc (Ho Chi Minh City) argued that the concept of "important and urgent national projects" is currently qualitative. Without specific criteria, its practical application could lead to inconsistent interpretations and potential legal risks for both investors and implementing agencies.

Based on this analysis, delegate Huynh Thi Phuc proposed adding a regulation that assigns the Government the task of determining specific criteria for this type of project, linked to capacity scale, impact on the energy system, and energy security requirements in each period. Clearly defining these criteria would increase transparency, limit differing interpretations, and create legal security for the projects.

Delegates also pointed out the current practice of having many lists of energy projects issued at different levels, such as: the list in the National Energy Master Plan (Decision 893/QD-TTg); the list of nationally important and key energy projects in Decision 2634/QD-TTg; and the new concept of important and urgent projects in the draft Resolution itself.

According to the delegates, although each category has different objectives, a lack of linkage and a mechanism for inheritance will lead to overlap, making it difficult to determine which projects are entitled to priority mechanisms, thereby affecting implementation progress.

Based on this, the delegates proposed clearly stipulating that projects included in the priority list in the Planning under Decision 893 should automatically be subject to the Resolution's mechanism, independent of the list in Decision 2634. At the same time, the content "List of important projects prioritized for investment in national sectoral plans" should be added to Articles 3, 17, 18, and 24 to ensure continuity and consistency. The delegates emphasized the need for decentralization of authority in determining and adjusting the list to increase proactiveness and avoid project delays due to excessive reliance on adjustment procedures.

Delegates also suggested the need to establish a unified legal framework, reduce internal procedures, increase accountability and post-auditing, and create favorable conditions for key projects to be implemented flexibly and promptly to ensure the Resolution is put into practice, contributing to ensuring energy security in accordance with the spirit of Resolution 70 of the Politburo on ensuring national energy security until 2030, with a vision to 2045.
