

Unblocking backlog investment resources, overcoming waste
The National Assembly Resolution on expanding the scope of application of Resolution No. 170/2024/QH15 dated November 30, 2024 of the National Assembly, presented by Minister of Finance Nguyen Van Thang, stated that the issuance aims to create a legal basis to promptly handle difficulties and obstacles for projects with long-standing backlogs in inspection, examination and judgment conclusions with similar legal situations nationwide. Thereby, contributing to unblocking backlog investment resources, overcoming waste, serving the goal of high economic growth.

Resolution on expanding the subjects of application of specific mechanisms and policies in Articles 3, 4, 5, 6, 7, 8 of Resolution No. 170/2024/QH15 dated November 30, 2024 to remove difficulties and obstacles for projects and land in inspection, examination conclusions, and judgments with similar legal situations nationwide.
The applicable subjects are similar to Resolution No. 170/2024/QH15 dated November 30, 2024; additional provisions for projects and land whose time of violations and infractions is determined in the inspection, examination and judgment conclusions before the effective date of this Resolution to avoid continuing to handle newly arising violations.

The draft Resolution consists of 4 Articles and the Government will stipulate and guide the organization of full and timely implementation of the Resolution. At the same time, the organization of the implementation of the Resolution after its promulgation includes disseminating and popularizing the Resolution; ensuring resources for implementation; supervising, inspecting, checking, and monitoring the implementation of the Resolution; and localities implementing the tasks assigned in the Resolution.
Removing obstacles for projects that have had inspection and examination conclusions
The review report presented by Chairman of the Economic and Financial Committee Phan Van Mai said that the Committee agreed with the necessity, political basis, legal basis, and practical basis of issuing the Resolution as presented in the Government's Proposal. The issuance of the Resolution aims to institutionalize the Party's policy on removing obstacles for projects that have been concluded by inspection, examination, and judgment nationwide, completely resolving long-standing backlog projects, unblocking investment resources, and maximizing the value of land resources.
The Committee agrees with the proposal that after the National Assembly reviews and comments, this content will be included in the Resolution of the 10th Session of the 15th National Assembly.

The Committee finds that the provisions in Clauses 2 and 3, Article 2 of the draft Resolution contain some contents that have been stipulated in Article 2 of Resolution No. 170/2024/QH15 and may lead to different understandings of the principles stipulated in Conclusion No. 77-KL/TW and the institutions in Article 2 of Resolution No. 170/2024/QH15. Therefore, it is recommended to review the principles for implementing the Resolution to ensure that there is no overlap and no different understandings of the principles stipulated in Conclusion No. 77-KL/TW and institutionalized in Article 2 of Resolution No. 170/2024/QH15.
The Committee also basically agreed to assign the Government to issue a list of land projects in the inspection, examination and judgment conclusions with similar legal situations.

At the same time, it is proposed to clearly stipulate as follows: “The Government is assigned to prescribe guidelines and organize the implementation of this Resolution; issue a list in the conclusion of inspections, examinations, and judgments with similar legal situations as prescribed in Clause 1, Article 1 of this Resolution and take full responsibility for the accuracy, completeness, and honesty of the list of projects and land…”.
