Previously, on July 27th, the People's Committee of Lam Dong province decided to approve the starting price for the auction of the lease of assets on the land and the annual land lease for Thuy Ta restaurant at plot number 04, cadastral map number 14, Ward 1, Da Lat City.
The Provincial People's Committee assigns the Department of Finance the responsibility for the process, documents, and procedures for determining the starting price and its conformity with market prices at the time of appraisal. The Department of Natural Resources and Environment advises the Provincial People's Committee to issue a Decision on land lease as the basis for signing land lease contracts in accordance with the Land Law.
The People's Committee of Da Lat City shall select an auction organization to conduct the auction for the right to lease the property as stipulated in Article 11 of Decision No. 01/2019/QD-UBND dated February 14, 2019, of the People's Committee of Lam Dong Province on the promulgation of regulations on leasing houses and villas owned by the State in Lam Dong Province; submit the results of the auction to the People's Committee of Lam Dong Province for approval and sign the lease contract with the winning bidder in accordance with regulations.
The Provincial People's Committee requires that agencies, organizations, and individuals participating in the auction must meet the conditions stipulated in Clause 3, Article 1 of Government Decree 10/2023/ND-CP dated April 3, 2023, amending and supplementing a number of articles of the Decrees guiding the implementation of the Land Law. Within 30 days from the date of signing the asset lease contract, they must pay the full amount to the agency assigned to organize the asset auction.
If the full auction price is not paid within the stipulated time limit, the buyer must pay a late payment penalty in accordance with the law on tax administration.
Violations of the prohibited acts stipulated in Clause 5, Article 9 of the Law on Auction of Assets and other relevant legal provisions will result in the cancellation of the auction results, compensation for damages, and penalties in accordance with the Law on Auction of Assets and other applicable legal provisions.
At the same time, the lease term, intended use, architectural planning, and payment method must be strictly adhered to as stipulated in Decision No. 697/QD-UBND dated April 4, 2023, of the Provincial People's Committee on auctioning the lease of assets on land and annual land rent for Thuy Ta Restaurant.
