Many large plots of land in Da Nang that are currently being put up for auction are being brazenly encroached upon by businesses for construction projects and storage areas for machinery and construction materials. In some cases, businesses even occupy public land and then organize others to dump rubble and waste, charging fees based on the number of trucks.
Breaking down fences to illegally occupy public land for construction.
A field inspection team from the Land Development Center under the Da Nang City Department of Natural Resources and Environment, in coordination with the People's Committee of Nai Hien Dong Ward, Son Tra District, recently inspected and issued a report against CDC Construction Joint Stock Company for brazenly demolishing fences and encroaching on a plot of land with three street frontages (Le Van Duyet, Ho Han Thuong, and Bui Duong Lich) to use as a material and machinery storage area.
This is a plot of land, over 11,300 square meters (clean land), that the Da Nang City People's Committee is auctioning off for the development of a commercial center and high-end apartment complex project. However, CDC Construction Joint Stock Company has brazenly cut through the corrugated iron fence and illegally occupied the land.
The plot of land with three street frontages on Le Van Duyet, Ho Han Thuong, and Bui Duong Lich streets has been illegally occupied and used as a storage area for materials, equipment, and machinery.
During the inspection, CDC Construction Joint Stock Company could only provide a written request to borrow land for construction purposes. Despite not having received a response from the local authorities or relevant agencies, the company had already broken through the fence and occupied the land.
CDC Construction Joint Stock Company cut through the corrugated iron fence to open a gate to the land, poured a 10cm thick concrete foundation over an area of approximately 300m2, and gathered materials, steel, beams, and machinery to construct the steel pipe frame.
Similarly, Duc Thanh Joint Stock Company is currently occupying a plot of land nearly 300m2 in size on Tran Nam Trung Street, Hoa Xuan Ward, Cam Le District (the land currently being auctioned for the construction of the Hoa Xuan Sports , Entertainment and Commercial Complex) to build housing for workers and to store machinery and materials.
The inspection team from the Land Development Center, in coordination with the Hoa Xuan Ward People's Committee, inspected and determined that Dac Thanh Cong Joint Stock Company had constructed a temporary shelter with a concrete and cement foundation, iron pillars, and a corrugated iron roof on an area of approximately 200 square meters.
Next to it, the company also built a water storage system, a concrete structure casting yard, and placed containers and oil tanks. During the inspection, the company representative was unable to provide a temporary construction permit or any related documents from the competent authority approving the land use.
The inspection team drew up a report, requesting Duc Thanh Joint Stock Company to cease all activities and construction work on the land and only to resume operations with the approval of the land's managing entity.
The land being auctioned for the construction of the Hoa Xuan Sports, Entertainment and Commercial Complex has been illegally occupied.
Occupying public land to dump construction debris for profit.
The encroachment on public land in Da Nang has been quite common recently, and there have been cases that have resulted in prosecution.
Specifically, on October 15th, the Economic , Corruption, Smuggling, and Environmental Crime Investigation Department of the Da Nang City Police issued a decision to initiate a criminal case, indict BMT (residing in Hoa Hiep Nam ward, Lien Chieu district, Da Nang), and prohibit him from leaving his place of residence to facilitate the investigation into the act of "causing environmental pollution".
According to the police, since May 2024, BMT has been providing demolition services for residential buildings to several households in Hoa Hiep Nam ward. According to regulations, BMT was required to transport construction waste, including rubble and debris, from the construction sites to a designated collection point at the Khanh Son Solid Waste Treatment Complex for processing and was obligated to pay for it.
However, to save costs, BMT instructed its employees to transport construction debris and dump it illegally at a plot of land at the end of Nguyen Ba Phat Street (Hoa Hiep Nam Ward), which is managed by the Da Nang Management Board for Investment and Construction of Civil and Industrial Works.
Not only does BMT dump construction debris and waste from its own demolition projects, but it also brazenly allows trucks carrying mud, debris, waste, plastic bottles, etc., from other places to dump at this site, charging a fee of 10,000 to 50,000 VND per truck, depending on the load.
To evade authorities, BMT used bulldozers to level, bury, and compact the dumped waste, then covered it with a thin layer of sand for camouflage.
The land was illegally occupied, and people were allowed to dump construction debris there in exchange for money.
Also in Lien Chieu district, the vacant land on Hoang Van Thai street, managed by the Hoa Khanh Nam ward People's Committee, Lien Chieu district, has been illegally occupied and turned into a giant construction waste dump.
Meanwhile, in Son Tra district, a plot of land measuring over 1,000 square meters, designated for auction as part of the Tho Quang Storm Shelter and Boat Mooring Project, has also been illegally occupied and turned into a dumping ground for construction debris, with an estimated volume of thousands of cubic meters.
According to data from the Da Nang Land Development Center, the unit currently manages 349 large land plots and 20,402 resettlement land plots. The city has approved the use of 47 land plots for auction, including 4 plots for the Da Nang International Fireworks Festival Complex Project in My An Ward, Ngu Hanh Son District; 12 plots for the Creative Space Project in Hoa Xuan Ward, Cam Le District; and 200 subdivided residential land plots for auctioning land use rights.
Da Nang has successfully auctioned off three large plots of land on a pilot basis and has approved auction decisions for 11 more plots of land to be used as temporary parking lots.
According to data from the Da Nang Land Development Center, there are currently more than 3,000 plots of land being encroached upon throughout the city, including over 140 large plots. To address the illegal encroachment on public land, the Da Nang Land Development Center is coordinating with local authorities to inspect and handle illegal encroachment, illegal construction, and the dumping of household waste and construction solid waste.
For city land plots that currently lack a planned use, they will be auctioned off for short-term leases to ensure efficient management and utilization. However, a major obstacle is awaiting guidance from the Ministry of Natural Resources and Environment regarding the drafting of legal regulations on short-term leasing of vacant land plots.
